Every owner of property in the Borough of Wilkinsburg shall, upon 30 days' notice from the Borough Council, Code Enforcement, and/or the Borough Council's designee to enforce said ordinance, construct or reconstruct a sidewalk or curb, which shall conform to all applicable requirements of this section, in front or alongside such property. Attachment A, "Surface Material"; Attachment B, "Design"; and Attachment C, "Repair," shall be the minimum standard used for all Wilkinsburg Borough sidewalks.[1] Attachments A, B, and C may be amended from time to time by resolution of the Borough Council. Due to the possibility of unforeseen weather conditions or change in seasons, the listed designees of enforcement may give the property owner an extended time to construct or reconstruct as weather permits.

All sidewalks shall be constructed, reconstructed and repaired of concrete, water-permeable concrete or recycled rubber, or pavers, according to specifications adopted by this article and outlined in Attachments A, B, and C by the Borough Council.[1] Amendments to the specifications may be done by resolution of the Borough Council, and provided, further, that within the Central Business District (which, for purposes of this section, is defined as the following area: Wood Street from the intersection of Rebecca Avenue to the intersection of Wallace Avenue and Penn Avenue from the Port Authority East Busway to the intersection of Ardmore Boulevard and Ross Avenue from the intersection of Hay Street to the intersection of Medicine Way, all sidewalks shall be constructed, reconstructed and repaired with a surface of concrete and brick pavers.

The widths of the sidewalk area, which shall extend from the property line to the outer edge of the curbing, on all streets in the Borough, except in such cases where Council may otherwise specially direct, shall be as follows:
A. 
On streets 60 feet or more wide, the sidewalk width shall be 12 feet wide.
B. 
On streets at least 50 feet but less than 60 feet wide, the sidewalk width shall be 10 feet wide.
C. 
On streets at least 40 feet wide but less than 50 feet wide, the sidewalk width shall be eight feet wide.
D. 
On streets at least 30 feet wide but less than 40 feet wide, the sidewalk width shall be six feet wide.
E. 
On streets less than 30 feet wide, the sidewalk width shall be of the same proportionate width as hereinabove provided.
F. 
Within the specified widths in Subsections A through C, three feet measured from the inside of the curb shall be retained as green space for street signage, fire hydrants, trees, mailboxes, utility poles, underground utility valves, etc. Alternatively, this three-foot section may be overlaid with brick pavers.
G. 
Within the specified widths in Subsections D and E, Borough Council, Code Enforcement, and/or the Borough Council's designee shall direct sidewalk construction or reconstruction where the continuous, three-foot green space section specified in Subsection F is not possible because of limited space or Americans with Disabilities Act minimum sidewalk width requirements.
H. 
Width specifications of sidewalks will be waived for continuance and conformity of already installed sidewalks on adjoining parcels or lots. Abutting to the existing sidewalks of adjoining parcels and lots will be done in a manner to provide for an even transition and will continue the existing width to provide for visual and transitional conformity.
All construction, reconstruction, repair, cutting, alteration or grading shall be done in the manner specified by the Borough Engineer and subject to its approval. All corner curbs must be constructed, reconstructed, repaired, altered or graded in a manner that meets or exceeds all applicable standards or requirements of the Americans with Disabilities Act concerning curb ramps and pedestrian crossings.
A. 
All sidewalks shall be constructed, reconstructed and repaired and the grading therefor done upon the line and grade obtained by the property owner from Code Enforcement and not otherwise. It shall be the duty and responsibility of Code Enforcement to determine, in the case of any individual property, whether the sidewalk shall be reconstructed or repaired and, if so, the specific part or parts thereof to be reconstructed or repaired. The owner of every property abutting upon which a sidewalk shall be constructed, reconstructed or repaired shall be responsible for providing safety and warning measures for the protection of the public, including a temporary walk where an existing sidewalk is being reconstructed or repaired.
B. 
Any valve boxes, curb boxes, manhole covers, etc., encountered or to be located in the sidewalk area shall be adjusted so that the top surface is flush with the top surface of the sidewalk. All valve boxes, curb boxes, etc., shall be left in such a way that the covers are easily removed, and the boxes shall function in the manner in which they were intended.
In case the owner of any property shall fail, neglect or refuse to construct, reconstruct or repair a sidewalk, within the time limit and as required by this section, and/or any notice given him or her pursuant to this section, the Borough shall have authority to cause such work of construction, reconstruction or repair, as the case may be, to be done or to rectify any work not in conformity with this section and/or the said notice and to collect the cost of such work of construction, reconstruction, repair and/or rectification, with any additional amount authorized by law, from such property owner in default.
