The purpose of this chapter is to promote the public health, safety, morals and general welfare and to assist in the prevention of fires in all school buildings and school buses in Forks Township. The short title of this chapter shall be the "Forks Township Schools No Smoking Ordinance."

The following conduct is hereby prohibited by this chapter:
A. 
It shall be unlawful for any person to engage in smoking or carrying of a lighted pipe, cigar, cigarette or tobacco product in any form in areas designated by "No Smoking" signs on school property, within the school buildings and school buses in Forks Township.
B. 
It shall be unlawful for any person to obscure, remove, deface, mutilate or destroy a posted "No Smoking" sign.
C. 
It shall be unlawful for any minor to smoke, throw or deposit any lighted or smoldering substance in any school building or school bus within Forks Township where smoking is prohibited by reason of posting "No Smoking" signs.

A. 
The Forks Township Fire Chief is empowered and authorized to order the appropriate school officials to post "No Smoking" signs on school property in each building, structure, room, place and school bus in which smoking shall be prohibited. The content, lettering, size, color and location of the required "No Smoking" sign shall be subject to the approval of the Forks Township Fire Chief.
B. 
Any violation of this chapter may be prosecuted by any principal or person in charge of any school within Forks Township, or by any designee of the persons described herein.

Any person who violates or permits a violation of this chapter, upon being found liable therefor in a civil enforcement proceeding, shall pay a fine of not less than $400 and not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the Township in the enforcement of this chapter. No judgment shall be imposed until the date of the determination of the violation by the District Justice and/or Court. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable rules of civil procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
