A. It shall be unlawful to store any fireworks in the City
except as may be necessary for the performance of a supervised public exhibition
of fireworks, as hereinafter provided for. Any such storage must be under
the supervision of and subject to the approval of the Fire Chief.
B. It shall be unlawful to sell or offer for sale any fireworks
or pyrotechnics in the City, provided that supervised public exhibitions of
fireworks and pyrotechnics may be given if a permit therefor be granted by
the Mayor and City Council in accordance with the provisions of this chapter.
C. Application of permits shall be made to the Fire Chief
or his/her designated representative at least 15 days in advance of the date
of the display upon a form obtained from the Crystal Lake Fire Rescue Department.
D. Every display shall be handled by a competent individual
who is a licensed lead pyrotechnic operator. Proof of such license shall be
submitted with the permit.
E. The applicant shall submit proof of insurance in the
amount of not less than $1,000,000 naming the City of Crystal Lake as an additional
insured. The insurance shall be conditioned on compliance with the provisions
of the Fireworks Use Act (425 ILCS 35/2 et seq.) and the regulations of the
State Fire Marshal.
F. The Fire Chief or his/her designated representative shall,
prior to the issuance of a permit, inspect the display site to determine that
such site will be in full compliance with the rules of the State Fire Marshal
which shall be based upon nationally recognized standards such as those of
the National Fire Protection Association (NFPA) 1123 Guidelines for outdoor
displays and shall not be hazardous to property or endanger any person or
persons.
G. Indoor displays shall be specifically prohibited.
H. The application shall contain the exact location of the
display, the number and type of fireworks to be used in the display and the
time and date or dates upon which the display will be held, including any
rain dates.
It shall be unlawful to keep or store any dynamite in the City in excess
of five pounds on any one premises or in any one building.
It shall be unlawful to keep or store any nitroglycerine or the explosive
commonly known as "TNT" in the City in any quantities, except for medical
or laboratory purposes, and for such purposes no more than 1/4 ounce shall
be store in any one building or premises.
It shall be unlawful to keep or store any black powder or gunpowder
or guncotton in excess of five pounds on any one premises in the City.
All explosives kept or stored in the City shall be kept and stored in
accordance with the rules enforced by the State Fire Marshal or the City's
Fire Chief, with regard thereto.
