As used in this chapter, the following terms shall have the meanings indicated:
SIDEWALK SALE
Includes the sale, display or disposal of goods, wares, merchandise, produce or vegetables on any public walk, street or alley, or at any private commercial shopping area, including but not limited to areas consisting of retail businesses on private property, commonly known as shopping centers, shopping malls or shopping service areas.
It shall be unlawful for any person, firm, corporation, church, club, charitable institution, organization or group to conduct a sidewalk sale in the City of Crystal Lake without first securing a license therefor from the City Manager or such person as he/she may designate.
Application for a license pursuant to the provisions of this chapter shall be made on a form provided by the City Manager or such person as he/she may designate. The applicant shall truthfully state in full the information requested on the application as follows:
A. 
Name and residence address of the applicant, if an individual;
B. 
Name and business address of the applicant, if a firm, corporation, charitable institution, church, club or organization;
C. 
Names and addresses of all businesses participating in the sale, if the application is made by a group of business people on behalf of business people in a geographical area, such as the downtown district;
D. 
Location of the place or places where the sidewalk sale is to be conducted;
E. 
Date or dates upon which the proposed sale is to take place;
F. 
A statement by the applicant that the sidewalk sale will be conducted in compliance with all applicable ordinances of the City of Crystal Lake relating to the public health, safety and fire protection.
There shall be no fee for a sidewalk sale license. No such license shall be valid for more than four days.
No such license shall be issued if, in the opinion of the City Manager or such person as he/she may designate, due to the number of sidewalk sales to be conducted in the particular area at the same time or due to the location or manner in which the proposed sale is to be conducted, such sale is likely to pose a significant threat to the public health, safety or welfare.
A. 
If the applicant is found to be fully qualified as provided herein, the City Manager or such person as he/she may designate shall issue a license pursuant to the provisions of this chapter, upon payment of the fee therefor.
B. 
The City Manager or the person designated by him/her shall revoke any license issued hereunder if the holder thereof is found to have violated any provision of this chapter, or of any other ordinance of the City of Crystal Lake relating to the public health, safety or fire protection.
The following regulations shall be complied with by each person, firm, corporation, church, club, charitable institution, organization or group conducting a sidewalk sale in the City of Crystal Lake:
A. 
No street, alley or fire lane shall be blocked by any merchandise offered for sale hereunder.
B. 
Merchandise shall be securely and adequately placed so that it will not endanger passersby or fall into or obstruct any street, alley or other public way.
C. 
An unobstructed passageway at least 44 inches in width shall be provided for pedestrian traffic.
D. 
A straight and unobstructed path shall be provided between each exit and any adjacent street, parking lot or other public way, which path shall be at least as wide as the exit doorway, but in no event less than 44 inches in width.
E. 
All sidewalk sales shall be conducted in compliance with all other ordinances of the City of Crystal Lake relating to the public health, safety, and fire protection.
The Chief of Police and the Fire Chief shall make or cause to be made sufficient inspections to ensure compliance with the provisions of this chapter and other applicable ordinances of the City of Crystal Lake by the personnel conducting such sales.
Any person, firm, or corporation violating the provisions of this chapter may, in addition to any penalty imposed under Chapter 1, Article II, General Penalty, of this Code, suffer the penalty of having his/her license revoked for any such violation. Revocation shall be in writing signed by the Mayor.
