A. 
The Division of Health shall provide a specialized food safety and manager's certification training recognized and approved by the New Jersey Department of Health and Senior Services to persons in the business of preparing, handling or processing of foods intended for human consumption in Risk Type 3 food establishments.
B. 
The fee for the manager's certification training, including the exam, is $180. The certification expires five years after it is issued.

All employers of persons required to hold food safety or manager's certification pursuant to N.J.A.C. 8:24 shall maintain a record of such employee, listing his name and address, date of employment, and a copy of the food safety or manager's certificate. Such records shall be made available at all times to the Health Officer upon request.
No person to whom a food safety or manager's certification is issued shall give, loan, transfer, sell to or permit the same to be used by any other person.
In the event that, pursuant to N.J.A.C. 8:24, the operator of a Risk Type 3 establishment fails to employ a person who has been certified in food safety by an organization approved by the New Jersey Department of Health and Senior Services, the Division of Health shall cite the establishment and hold a hearing, the subject of which shall be a plan of corrective action setting forth a reasonable time frame to ensure the establishment owner's employment of such a person. If, after the reasonable time frame set forth at the meeting, the operator fails to comply, the Division of Health shall be authorized to revoke the license and order the establishment closed until compliance is procured. Revocation of licenses, closure of the establishment, and reinstatement of licenses shall be subject to the provision of Article IX of this chapter.
