As used in this chapter, the following terms shall have the meanings
indicated:
IDENTIFICATION
A card or document used by a person to induce the Passaic Free Public
Library to lend and transfer custody of materials owned by or in custody of
the Passaic Free Public Library.
PERSON
Includes a natural person, partnership, corporation, estate or trust.
RULES AND REGULATIONS
Such regulations and rules adopted by the Passaic Free Public Library
Board of Trustees now or in the future pertaining to the borrowing or lending
of library materials, the period of time for which they are lent, fines, costs
and other penalties as set forth in various resolutions of said Board.
No person shall produce Use identification or use another's to
reduce the Passaic Free Public Library to lend materials to him/her.
No person shall willfully or maliciously tear, deface, disfigured, damage
or destroy any book, article, material or other matter of any kind which is
owned by or in the primary custody of the Passaic Free Public Library.
No person shall retain or fail to return any book, article, material
or any other matter borrowed from the Passaic Free Public Library more than
15 days from the date of mailing of certified mail, return receipt requested,
of a notice demanding return thereof. Such notice shall be addressed to the
said person at his or her last known address, which shall be the address most
recently shed to the Passaic Free Public Library by the person in question.
Failure of the person addressed to claim such notice shall not constitute
a defense.
No person shall remove from the Passaic Free Public Library any book,
article, material or other matter of any kind without first having the same
charged to his/her borrower's card.
The Director of the Passaic Free Public Library or his/her representative
is hereby vested with the authority to prosecute any and al persons who violate
the provisions of this chapter or of any rule or regulation adopted by the
Board of Library Trustees.
Each violation hereunder shall constitute a separate and distinct violation,
and each day a violation exists shall constitute a separate and distinct offense.
In adopting this chapter, the City Council of the City of Passaic takes
cognizance of a growing problem for all libraries and sets forth herewith
its legislative intent that violators of this chapter be dealt with to a degree
of severity commensurate with the extent to which they deprive others of the
enjoyment of the materials they have damaged, retained or appropriated or
otherwise treated contrary to the rules and regulations of the Passaic Free
Public Library and standards of common courtesy and decency.
Any person convicted of violating any of the provisions of this chapter
shall be subject to a fine of not less than $50 nor more than $1,000 or imprisonment
for a term not to exceed 90 days, or both.
