To provide a procedure for the application for use of municipal parks by profit-making entities for special events.
As used in this article, the following terms shall have the meanings indicated:
PUBLIC PARKS
The following Township parks shall be regulated by this ordinance: Laird Road Park; and Bucks Mill Park. All other Township parks or preserves shall not be eligible for use by profit making entities.
ENTITIES
Refers to any person, organization, group or business that applies for a permit to utilize the aforementioned parks that is engaged in profit making activities.
SPECIAL EVENTS
Includes such profit-making activities as sports events, pageants, celebrations, historic reenactments, parades, fairs, festivals and similar events that relate to and are within the basic mission of the Colts Neck Parks and Recreation Department.
A. 
Permit applications shall be submitted in writing to the Director of the Colts Neck Recreation and Parks Department at least 45 days prior to the event.
B. 
The application shall state the following:
(1) 
The name and address of the applicant.
(2) 
The day(s) and hours for which the permit is desired.
(3) 
The park or portion thereof for which such permit is desired.
(4) 
An estimate of the anticipated attendance.
(5) 
A list of any temporary equipment that will he utilized, such as tents, stages, bleachers, soundmaking devices, bandstands, and similar items.
(6) 
A list and location of any signs to be utilized.
(7) 
An estimate of the anticipated traffic and a statement of how the applicant will control said traffic to and from the location. including parking.
(8) 
A list of any and all subcontractors who may be used in either the setup or operation of the event.
(9) 
Any other information as may be requested by the Director of Recreation and Parks.
A. 
Approval or denial of a permit will be determined by the Township Committee of the Township of Colts Neck.
B. 
In determining whether to approve a proposed special event, the Colts Neck Township Committee shall consider and base its determination upon the following criteria:
(1) 
Whether the proposed special event relates to and is within the basic mission of the Colts Neck Recreation and Parks Department.
(2) 
Whether the park requested is reasonably suited relative to the size and nature of the proposed special event.
(3) 
Whether the application provides satisfactory information to the information requested and has been deemed complete by the Colts Neck Director of Recreation and Parks.
(4) 
Has the potential to cause injury or damage to park resources.
(5) 
Whether the special event will present a danger to public health and safety and conforms to all other applicable federal, state or local regulations.
(6) 
Whether the special event will result in a significant conflict with other existing uses.
As a condition of permit issuance, the following may be requested:
A. 
The filing of a bond or cash in an amount adequate to cover costs such as restoration and cleanup of the area or park to be utilized.
B. 
Proof of liability insurance in a minimum amount of $1,000,000 in bodily injury and $1,000,000 property damage, unless an increase is warranted by the Township Committee.
C. 
An additional endorsement naming the Township of Colts Neck as additional insured.
D. 
An indemnity and hold harmless agreement to be executed by the applicant.
E. 
Permit issuance shall be conditioned upon the applicant's payment of all expenses, such as but not limited to: first aid, police, traffic control, security, utilities and sanitation.
F. 
Violations of the terms and conditions of a permit is prohibited and may result in the immediate revocation or suspension of the permit.
G. 
A permittee shall be bound by all Township park rules, regulations and ordinances as if same were inserted in said permit.
Fees will be established by the Township Committee of the Township of Colts Neck on a case-by-case basis, utilizing but not limited to the criteria provided in § 177-51 above, with a minimum fee of $5,000 per special event.
