This chapter, together with any and all ordinances supplementary hereto as amendatory hereof, shall be known as the "Sanitary Code of the Township of Colts Neck."
Whatever is dangerous or detrimental to the public health, whatever renders the air, water, soil or food a hazard, menace or a detriment to human health, and the following matters, things, conditions or acts, and each of them, are hereby declared to be a nuisance and injurious to the health of the inhabitants of this municipality:
A. 
Pollution, or existence of a condition or conditions which cause or threaten pollution of any waters in this municipality in such manner as to cause or threaten injury to any of the inhabitants of this municipality, either in their health, comfort or property.
B. 
The disposition or maintenance of any foul, decaying or offensive matter in or upon any lot, yard, street or in any private or public place.
C. 
The maintenance of any sunken lot, spot or excavation or any cans, barrels or other receptacles where water may stagnate or mosquito or other insect larvae breed; except, however, any accumulation of stagnant water resulting from the natural terrain.
D. 
The throwing or overflowing of any water, slops, stable drainage, liquid filth, cesspool or privy contents upon any public or private property.
E. 
Any polluted stream of water, spring, well or source of drinking water.
F. 
Sleeping in, or permitting any person to sleep in, any cellar, basement or other place that is or may be in a condition prejudicial to health because of lack of light, lack of proper ventilation, dampness, lack of proper heating, plumbing or sanitation facilities.
G. 
Any chimney, smokestack, pipe or flue, or any part thereof or any connection therewith, that is so defective or out of repair as to allow coal gas or other noxious fumes to escape into any building; and also any gas pipe or other fixture which allows illuminating gas to escape into any building.
H. 
Any unclean or unsanitary condition in any cellar, room or building, and any imperfect plumbing, sewer appliance or fixture from which there may issue any foul or noxious odors or liquids; the permitting to remain of human waste in any form in or on any plumbing fixture or upon the floor or walls of any toilet room or bathroom.
I. 
The housing of horses, cattle, swine, goats, sheep, rabbits, fowl or pigeons under unsanitary conditions, or any of the same in any building used as a habitation for human beings.
J. 
Having used refrigerators on any property without having the doors removed.
K. 
Maintenance of any collection of manure, garbage or other waste in which the larvae of insects may breed, or in such location as to cause contamination of a stream or well.
L. 
Depositing, accumulating or dumping anything that offers or produces a breeding or hiding place for rodents, vermin or insects.[1]

A. 
Purpose. To prohibit illicit connections to the municipal separate storm sewer system(s) operated by the Township of Colts Neck, so as to protect pubic health, safety and welfare and to prescribe penalties for the failure to comply.
B. 
Definitions. For the purpose of this section, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
DOMESTIC SEWAGE
Waste and wastewater from humans or household operations.
ILLICIT CONNECTION
Any physical or nonphysical connection that discharges domestic sewage, noncontact cooling water, process wastewater, or other industrial waste (other than stormwater) to the municipal separate storm sewer system operated by the Township of Colts Neck, unless that discharge is authorized under a NJPDES permit other than the Tier A Municipal Stormwater General Permit (NJPDES Permit No. NJG0151564). Nonphysical connections may include, but are not limited to, leaks, flows or overflows into the municipal separate storm sewer system.
INDUSTRIAL WASTE
Nondomestic waste, including but not limited to, those pollutants regulated under Section 307(a), (b) or (c) of the Federal Clean Water Act [33 U.S.C. § I 3l 7(a), (b) or (c)].
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
A conveyance or system of conveyances, (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains) that is owned or operated by the Township of Colts Neck or other public body and is designed and used for collecting and conveying stormwater.
NJPDES PERMIT
A permit issued by the New Jersey Department of Environmental Protection to implement the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A.
NONCONTACT COOLING WATER
Water used to reduce temperature for the purpose of cooling. Such waters do not come into direct contact with any raw material, intermediate product (other than heat) or finished product. Noncontact cooling water may, however, contain algaecides, or biocides to control fouling of equipment such as heat exchangers and/or corrosion inhibitors.
PERSON
Any individual, corporation, company, partnership, firm, association or political subdivision of this state subject to municipal jurisdiction.
PROCESS WASTEWATER
Any water which, during manufacturing or processing, comes into direct contact with or results from the production or use of any raw material, intermediate product, finished product, by-product, or waste product. Process wastewater includes, but is not limited to, leachate and cooling water other than noncontact cooling water.
STORMWATER
Water resulting from precipitation (including rain and snow) that runs off the land's surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.
C. 
Prohibited conduct. No person shall discharge or cause to be discharged through an illicit connection to the municipal separate storm sewer system operated by the Township of Colts Neck any domestic sewage, noncontact cooling water, process wastewater, or other industrial waste (other than stormwater).
A. 
The Code Enforcement Officer, Health Officer and members of the Police Department of the Township shall have the power to enforce any violations of this chapter.

B. 
Any person, firm or corporation who shall violate any of the provisions of this chapter shall be punishable as provided in § 1-9 of this Code. In case a defendant shall have been twice convicted, within the space of six months, of the violation of these codes and ordinance, or due proof of such fact is made, the court may, in addition to the imposition of a fine, cause the defendant to be imprisoned in the County Jail or County Workhouse, with or without hard labor, for any number of days not exceeding one for each $1 of the penalty.
