A.
The Borough of Sayre shall collect residential waste and ashes from one- and two-unit residential properties within the limits of said Borough as hereinafter provided. All residential properties consisting of three or more units are considered commercial in nature, and waste collection and disposal is the responsibility of the property owner. The Borough shall only accept said residential waste and recyclable materials as defined in this chapter and as defined in Chapter 135, Recycling.
As used in this article, the following terms
shall have the meanings indicated:
Includes ashes from coal or wood.
Includes but is not limited to mattresses, carpet, rubber
goods (such as tires), scrap metal, sheet metal, used furniture, appliances
(only refrigerators, freezers and air conditioners that have been
certified as freon-free and their appliance doors removed). Items
excluded from this definition are all motor vehicles and items of
more than 200 pounds weight.
Aluminum cans, clear glass, colored glass, newsprint, certain
plastics and such other materials, if any, as specified from time
to time by the municipality to be recycled. These materials are specified
in the recycling regulations and may be revised from time to time
as deemed necessary by the Borough Council.[1]
Includes any offal or refuse of fish, fruit, vegetable, animal
matter or any other organic substance subject to fermentation or decay,
nonrecyclable items such as some types of paper, street sweepings,
old shoes, old cloth, broken glass and china, small pieces and limited
quantities of scrap metal, all resulting from the ordinary conduct
of housekeeping. Items excluded from this definition are (but not
limited to) all items listed under "junk goods," major demolitions
debris, hazardous and flammable waste materials such as drain cleaners,
paint and associated products, motor oil, pesticides and herbicides.
Leaves, garden residues, shrubbery, grass clippings, Christmas
trees and tree trimmings and similar material. Excludes waste resulting
from tree removal and waste resulting from the conduct of commercial
operations or operators.
A.
All householders shall drain the residential waste
of all liquids, and the waste shall be deposited in suitable containers.
B.
Containers used for residential waste.
(1)
The Borough recommends the use of hard-form containers
made of metal or plastic for residential waste. These containers must
have covers and handles.
(2)
The Borough does not recommend the use of plastic
bags. If plastic bags are used, they must be securely closed and be
of substantial construction so as to preclude rupture of the bag and
spillage of the contents.
(3)
The Borough or Borough employees will not be responsible
for the cleaning up of the contents of a ruptured plastic bag.
(4)
The property owner can utilize two forty-five-gallon
capacity containers of a weight not to exceed 50 pounds per container
or three thirty-two-gallon containers of a weight not to exceed 50
pounds per container for any scheduled pickup period.
(5)
On the days advertised for collection, the containers
must be placed on the curb of the street or at a point most convenient
and agreeable to the collector. Where alleys exist and collection
occurs via the alley, containers may be placed on the rear of the
owner's property at a point most convenient to the collector.
C.
Containers used for ashes. Containers used for ashes
must be metal with covers and handles and must not be larger in content
than 20 gallons' capacity and not more than 50 pounds in weight. Residents
must ensure that all ashes set out for collection are entirely extinguished.
D.
Containers for residential waste, ashes and recyclables
must not be damaged, destroyed or removed from the properties where
they are placed except by the householder or owner or with his/her
consent.
E.
Residents who wish to place more than three containers
or equivalent bundle for any scheduled pickup must purchase one sticker
per container or equivalent bundle from the Borough's Administration
Department during normal working days and hours. The Council will
set the fee for the sticker through resolution.
F.
The fee for the sticker option is hereby set at $1
per sticker. The fee may be increased as necessary by resolution of
Council. Each sticker entitles the purchaser to place out for collection
one container or equivalent bundle.
G.
All residents residing in residential or commercial
properties shall dispose of any medical wastes by a proper method
recommended by the Department of Environmental Protection. Any person
disposing of disposable needles and syringes, such as testing devices
for blood, i.e., diabetics, and/or insulin users, i.e., diabetics,
and other users using medically approved needles, shall place the
used needles in a solid container and seal the same before disposing
said medical waste in the municipal collection system and/or in a
private hauler system.

Nonrecyclable magazines, paper and cardboard,
when the quantity is too large to be placed in containers, shall be
securely tied into bundles, each bundle not to exceed 50 pounds, and
each bundle to be counted the same as a container.
The hours, days, times, places and amounts of
removal of residential waste and ashes shall be governed by rules
and regulations which may be revised from time to time as the Borough
Council may determine.[1]

The Borough Council may schedule specific periodic
collections and disposal of items included in the definition of "junk
goods." The cost of this collection and disposal shall be supported
by appropriate additional fees as determined by the Borough Council.
These fees shall be paid by each resident requesting this service.
All containers and vehicles (powered and nonpowered)
used in the collection and transporting of residential waste, ashes,
organic waste, junk goods and recyclable material within the limits
of the Borough shall always be kept in a clean and sanitary condition,
maintained so as not to create a public nuisance or be in any way
a menace to the public health, and shall at all times be subject to
a rigid inspection by the Manager for the Borough of Sayre or any
other authorized agent of said Borough.
The Borough Council of Sayre is hereby authorized
and directed to make such rules and regulations as it shall determine
relative to the removal of residential waste, ashes, organic waste,
junk goods and recyclable materials. Said Council is hereby further
authorized to make contracts for removal of residential waste, ashes,
organic waste, junk goods and recyclable materials or such other arrangements
as it may deem best for removal of the same.
A.
Any person, firm or corporation who or which shall
violate or fail to comply with any of the provisions of this article
shall, upon conviction, be sentenced to pay a fine of not more than
$600 and costs of prosecution and, in default of payment of such fine
and costs, be imprisoned for a term not exceeding 30 days.
B.
The provisions of this article shall be enforced by
the Police Department of Sayre Borough.
