The purpose of this article is to protect residents from the
unreasonable burden in gaining access to their residences, reduce
hazardous traffic congestion, enhance neighborhood safety, reduce
air pollution and noise resulting from vehicular traffic, preserve
both the residential character of our community and the value of property,
and to promote health and welfare of the residents of Sayre Borough.
A parking permit shall not guarantee or reserve a parking space within
a designated residential parking permit area. The Borough Council
may from time to time adjust the streets assigned to this program,
time limits, or other details through an ordinance of Council.

As used in this article, the following terms shall have the
meanings indicated:
NONRESIDENT VEHICLE
Any motor vehicle not eligible to be issued a residential
parking permit pursuant to the terms and conditions of this program
for the specific area in which it is parked.
RESIDENT
Any person 18 years of age or older whose legal residential
address is in the designated residential permit parking area.
RESIDENT VEHICLE
Any motor vehicle eligible to be issued a residential parking
permit pursuant to the terms and conditions of this program for the
specific area in which it is parked.
TEMPORARY RESIDENT
Any individual whose legal residence is not the Borough of
Sayre, Pennsylvania, and who resides, in the Borough because of business,
commercial, educational, or medical reasons for a period of time.
Said individuals do not plan to permanently reside in the Borough
and will not change their vehicle registration from their official
home of record or legal residence.
VISITOR
A person who does not reside within a designated residential
permit parking area, but is visiting or residing with a resident on
a temporary basis.

A. Zones. The residential parking program consists of six zones in the Borough of Sayre identified as permit parking Zones A, B, C, D, E and F. No person will be permitted to park a motor vehicle within these zones Monday through Friday from 8:00 a.m. to 5:00 p.m., except on legal holidays as defined in §
163-1B, unless:
(1) There appears on the motor vehicle in a location to be designated
by the Borough from time to time a parking sticker as provided hereinafter;
or
(2) There appears in a visible location on the front dashboard or other
location to be designated by the Borough a valid visitor card as provided
hereinafter which authorizes parking within the specific residential
parking program zone.
B. Eligibility for permanent Borough residents.
(1) Any permanent resident of the Borough of Sayre living within the residential parking program zone as set forth in §
163-85, Schedule of streets, hereof shall be entitled to receive a residential parking sticker for each eligible vehicle for the specific permitted zone where such person resides.
(2) Said permit will be nontransferable and valid only for the specific
permitted zone.
(3) Each applicant must provide evidence of residency within the Borough
of Sayre through the person's driver's license and proof of ownership
of a motor vehicle registered in the Commonwealth of Pennsylvania.
Joint owners of a motor vehicle or vehicles shall be considered as
one applicant.
(4) All outstanding parking tickets must be paid before a parking permit
may be issued.
C. Eligibility requirements for temporary residents.
(1) The Chief of Police, or his designee, may issue a residential permit
parking permit to a temporary resident, provided:
(a)
The temporary resident provides proof of residency in the Borough
of Sayre, e.g., rental lease, utility bill, or other official document
identifying his or her residence's location.
(b)
Proof of ownership of the vehicle to be registered.
(c)
Documentation or written statement of the estimated period the
individual expects to reside in the Borough.
(2) The temporary resident must apply for and meet the conditions for
a residential parking permit if he or she becomes a permanent resident
of the Borough.
D. Permit stickers and visitor permits.
(1) Residential permit parking stickers:
(a)
Permit stickers will be of such a size and design as the Borough,
from time to time, deems appropriate. These stickers shall be serialized
and will be color coded to indicate the zone for which they are valid.
(b)
A residential parking permit shall not authorize its holder
to stand or park a motor vehicle in any place where, or at any time
when, stopping, standing or parking of motor vehicles is prohibited
or set aside for other specified types of vehicles; nor shall the
permit exempt its holder from the observance of any traffic or parking
regulation other than residential parking permit regulation or restriction;
nor shall the permit holder utilize the parking privilege outside
of the zone for which the permit was issued.
(c)
Residential permit parking stickers are deemed the property
of the Borough of Sayre.
(2) Visitor permits.
(a)
Each residence within the residential parking program area is
eligible to receive two visitor permits for nonresident visitor vehicles.
These cards shall be of such size and design as the Borough, from
time to time, deems appropriate. Such cards will be displayed hanging
from the rearview mirror in a manner to make them visible from outside
the vehicle.
(b)
Such visitor parking permits shall contain the following: the
designation of the residential parking permit area; the name and address
of the resident to whom the parking permit was issued; and the expiration
date of the parking permit.
(c)
Visitor permits shall not be used by the homeowner's employees;
nor shall the visitor permit holder utilize the visitor parking privilege
outside of the block within the zone the visitor permit was issued.
Visitor permits will not be used on residents' vehicles.
(d)
These visitor permits shall not be used for parking a vehicle
in a residential parking permit zone to go to a place of employment,
school, or other activities, including, but not limited to, doctor
appointments, hospital visits, funerals, professional visits, etc.
(e)
The visitor must be physically spending time with the resident
during the day he or she is utilizing the visitor permit.
(f)
Temporary visitor permits shall be displayed on or about the
front windshield of the vehicle to be easily visible from outside
the vehicle.
(g)
Visitor permits are deemed property of the Borough of Sayre.
If lost, the permit will not be replaced.
E. Leased vehicles and company vehicles.
(1) Leased vehicles. Any person otherwise eligible for a residential
parking permit in any permit area may obtain a residential parking
permit for a leased vehicle by presenting a true and correct copy
of a bona fide lease agreement between the applicant and a leasing
entity engaged in the leasing of vehicles in the usual and ordinary
course of its business.
(2) Company vehicles. Any person otherwise eligible for a residential
parking permit in any permit area may obtain a residential parking
permit for a motor vehicle owned by a business or company of which
he or she is an employee by presenting a letter on the business/company
letterhead, which shall state that the applicant is currently employed
by the company, that the applicant is required by the business or
company to use the motor vehicle on a regular basis and that the Borough
is authorized to issue a residential parking permit for the motor
vehicle.
F. Special event permits.
(1) Upon written application to the Police Chief, or his designee, special
permission may be obtained for special event permits to be used for
limited hours during special events. Such applications must identify
the purpose of the event, the date and times, the number of vehicles
expected and the name of the responsible person to contact with respect
to said event. These special cards will be issued only to the responsible
person requesting the special event permits and will be valid for
no longer than 24 hours.
(2) The Police Chief, or his designee, shall grant such number of special
permits as he shall deem appropriate, after consideration of the health,
safety, and welfare of the residents of the surrounding community,
residents of the residential parking program and the purposes of the
residential parking program. When such permission is granted, the
Police Chief, or his designee, shall notify the applicant and the
Sayre Police Department.
G. Exemptions. The following owners and operators are exempt from the
provisions of this article:
(1) Owners or operators of emergency vehicles, municipal vehicles and
state vehicles.
(2) On-duty law enforcement personnel.
(3) Clergy, medical, or social services personnel on house calls within
the residential parking program area.
(4) Privately owned vehicles of Fire Department, Police, or Fire Police
personnel when responding to an active and/or ongoing emergency.
(5) Service and utility vehicles, clearly labeled as such, during the
time that persons from said service or utility company are performing
a service within the residential parking program zone.
(6) Commercial delivery vehicles clearly labeled as such when the delivery
persons are performing their deliveries within the residential parking
permit zones.
(7) Bona fide and permitted contractors and their employees' vehicles
while employed at a work site located within one of the parking permit
zones.
H. Transfer of stickers forbidden. If a person sells or disposes of
his or her motor vehicle, he or she will remove the sticker and return
it to the Police Chief, or his designee. If a replacement vehicle
is purchased, the old sticker will be exchanged for a new one.
I. Revocation.
(1) When the Police Chief, or his designee, has reason to believe that
a residential parking program sticker or visitor permit was issued
in error, or that a person to whom a sticker or visitor permit was
issued is no longer eligible, or that a person to whom a sticker or
visitor permit was issued has violated the requirements of this article,
the Police Chief, or his designee, shall notify the possessor of the
sticker and visitor permit advising that person of the ineligibility
or violation.
(2) If the violation continues and/or the person is unable to demonstrate
that he or she is eligible or continues to be eligible for a residential
parking program sticker or visitor permit, then the Police Chief,
or his designee, may revoke the parking sticker or visitor permit.
J. The Borough may from time to time make changes or adjustments to
the residential permit parking program through the ordinance process.

A. It shall be unlawful and a violation of this article for a person
to falsely represent himself as eligible for a parking permit or to
furnish false information in an application therefor to the Police
Chief, or his designee, and/or the Police Department.
B. It shall be unlawful and a violation of this article for a person
holding a valid parking permit issued pursuant hereto to permit the
use or display of such permit on a motor vehicle other than that for
which the permit is issued. Such conduct shall constitute an unlawful
act and a violation of this article by both the person holding the
valid parking permit and the person who so uses or displays the permit
on a motor vehicle other than that for which it is issued.
C. It shall be a violation of this article for a person to copy, produce
or otherwise bring into existence a facsimile or counterfeit parking
permit or permits without written authorization from the Police Chief,
or his designee. It shall further be unlawful and a violation of this
article for a person to knowingly use or display a facsimile or counterfeit
parking permit to evade time limitations on parking applicable in
a residential permit parking area.
D. It shall be unlawful and a violation of this article for a person
who has been requested to return his or her guest visitor permit by
the Police Chief, or his designee, to refuse to return said revoked
card to the Police Department.
E. Any person, firm or corporation who or which shall violate or fail to comply with any of the provisions of this article and/or shall be specifically found in violation of Subsections
A,
B,
C, or
D as set forth above, upon conviction, shall be sentenced to pay a fine of not more than $600. Each day's continuance of the offense shall constitute a separate offense subject to a $600 fine, together with the costs of prosecution.
