The purpose of the Downtown Commercial CD District is to designate an area for retail commercial activity to serve the needs of the residents of the Borough. Whenever possible, the property owners should locate retail and service businesses on the street level with offices and other permitted uses on the upper levels of the building.
A. 
Permitted uses in the Downtown Commercial CD District are as follows:
(1) 
Art supplies; frames.
(2) 
Appliance sales and repairs.
(3) 
Banks and other financial institutions.
(4) 
Barbershops and beauty parlors.
(5) 
Book and stationery stores.
(6) 
Clubs and lodges.
(7) 
Cigar stores.
(8) 
Department stores and specialty shops.
(9) 
Drug stores.
(10) 
Dry goods and variety stores.
(11) 
Dry-cleaning and clothes-pressing establishments, provided that nonflammable cleaning agents are used.

Eating and drinking places.
(13) 
Footwear Stores.

Permitted accessory uses in the Downtown Commercial CD District are as follows:
A. 
Accessory uses and buildings customarily appurtenant to a principal permitted use, such as incidental storage.
B. 
Off-street parking and loading facilities.

The following special exceptions may be permitted by the Zoning Hearing Board, following review and comment by the Planning Commission, pursuant to standards and criteria as set forth in Articles XIV and XX herein:
A. 
Conversions. See § 173-88A(5).
B. 
Multifamily dwellings.
C. 
Rooming houses.
D. 
The following limited light industrial uses when totally conducted within an enclosed building:
(1) 
Manufacturing of apparel, jewelry, toys and novelties.
(2) 
Photo processing, printing and laboratories.
E. 
Place of public assembly (must meet the general parking regulations under §§ 173-111, 173-112, 173-113, 173-114, 173-115 and 173-116.)
F. 
Churches, Sunday schools, and other places of worship (must meet the general parking regulations under §§ 173-111, 173-112, 173-113, 173-114, 173-115 and 173-116.)

Conditional uses in the Downtown Commercial CD District are as follows:

A. 
The height of any building or structure shall not exceed 60 feet.
B. 
The boarding of windows of buildings in the Downtown Commercial District shall be prohibited.
Unless otherwise specified herein, lot area, lot width and impervious coverage requirements of the following dimensions shall be provided for each structure or use hereafter erected, established or altered for any use permitted within this district:
A. 
Lot area: none required.
B. 
Minimum lot width: none required.
(1) 
Building setback line: none required.
C. 
Coverage regulations.
(1) 
Lot coverage: none required.
D. 
Minimum lot depth: 120 feet.
The following setback regulations apply to all uses permitted within this district unless otherwise specified herein.
A. 
Front yard: none.
B. 
Side yard: When abutting a residential district a minimum of 15 feet shall be provided.
C. 
Rear yard: When abutting a residential district the rear yard shall be 50 feet.
D. 
Screening: shall be required as set forth in § 173-93.
