Pursuant to the specific power granted to municipalities under C.G.S.
§ 7-148(7)(D)(i), the Town Council of the Town of Newington hereby
regulates and prohibits the going of dogs at large to prevent dogs from roaming
on public property and private property in order to prevent damage to public
and private property, to lower the incidence of dog bites and attacks, and
to protect dogs and the community from the dangers posed by roaming dogs on
public highways.
As used in this article, the following terms shall have the meanings
indicated:
All land not owned or under the control of the owner or keeper, or
agent thereof, of any dog.
All state- and Town-owned, -leased, or -controlled property, including,
but not limited to, all public parks and recreation areas, school properties,
and public highways.
It shall be unlawful for the owner or keeper, or agent thereof, of any
dog to allow such dog to enter upon public or private property except when
permission is granted by the owner or person in control of such property,
or except when such dog is under the control of its owner or keeper, or agent
thereof, and such dog is kept on a leash under proper control.
Any dog found roaming on public or private property in violation of § 153-19 of this article may be taken into custody by the Animal Control Officer pursuant to C.G.S. § 22-332, and the Animal Control Officer shall otherwise enforce the provisions of this article in accordance with the provisions of C.G.S. § 22-332.
The owner or keeper of any dog found in violation of § 153-19 of this article shall be fined $25 for each violation. Each day that a violation occurs or continues shall constitute a separate offense. Such owner or keeper shall be issued a notice of violation stating the nature of the violation, the amount of the fine to be paid, and the answer date by which the fine must be paid. Unless a plea of not guilty is entered by the answer date given on the notice of violation, failure to pay the fine by the date provided in the notice shall cause the amount of the fine to triple. Payment shall be made to the Town of Newington.
The penalties imposed by this article are not to be applied to the exclusion
of other remedies or penalties that the Animal Control Officer may have regarding
violations of this article or any other state statute, regulation or ordinance.
