No person shall convey or cause to be conveyed upon or through the streets
or sidewalks of the Town, ashes, dirt, rubbish of any kind or any other substance
in such a manner and so insecurely covered that any part of the same is likely
to escape from the vehicle in which the same is being conveyed and be deposited
upon the ground or in the air to the discomfort or detriment of the public,
or so as to become unsanitary or unsightly or to otherwise constitute a nuisance.
Any person violating the provisions hereof shall be fined not to exceed
$5 for each offense.

For the purposes of this article, the following terms shall have the
meanings indicated:
LITTER
Any discarded, used or unconsumed substance or waste material, whether
made of aluminum, glass, plastic, rubber, paper, or other natural or synthetic
material, or any combination thereof, including, but not limited to, any bottle,
jar or can, or any top, cap or detachable tab of any bottle, jar or can, any
unlighted cigarette, cigar, match or any flaming or glowing material or any
garbage, trash, refuse, debris, rubbish, grass clippings or other lawn or
garden waste, newspaper, magazines, glass, metal, plastic or paper containers
or other packaging or construction material which has not been deposited in
a litter receptacle.
Violations of this article shall be punishable by a fine of $90 for
each occurrence. Persons who wish to appeal the issued fine may do so by filing
the appropriate appeal form within 30 days of the issuance of the fine with
the Town Manager, who shall make a final determination.
