All construction and installation of streets, storm drainage management
systems, sanitary sewer facilities, site grading and other improvements needed
to comply with plans approved by the Commission under these Regulations are
the responsibility of the applicant, or the applicant's agent, and shall
be carried out and completed in accordance with the following:
A. The Construction, Site Development and Grading Plans
as approved by the Town Engineer/Director of Public Works and the Commission,
including any construction program or work sequence approved by them;
B. The Soil Erosion and Sediment Control Plan as certified;
and
C. The "Specifications for All Roads to be Accepted and
Maintained by the Town of Orange, Connecticut," dated November 2003, as the
same may be amended from time to time.

In addition to the supervision requirements of §
382-8, the Town Engineer/Director of Public Works and the Commission, or their authorized agents, shall have free access to the construction work at all reasonable times and are deemed authorized to take materials samples and cores and make other tests as deemed necessary to determine compliance with plans approved by the Commission and these Regulations. They may require the applicant or the applicant's contractor, at the applicant's expense, to have such tests made and certified by a professional engineer or qualified testing laboratory.
The applicant, or the applicant's contractor, shall give timely
notice to the Town Engineer/Director of Public Works, or to the authorized
inspection agent thereof, prior to each of the following stages of work:A.
Commencement of site clearance and grading and after the construction work
has been staked out;
A. Commencement of excavation and grading of streets and
installation of embankments;
B. Commencement of installation of storm drainage systems,
sanitary sewer facilities and structures;
C. Backfilling of storm drainage management systems, sanitary
sewer facilities and structures;
D. Placement of the base course on the subgrade of a street;
E. Commencement of construction of the paved surface of
a street; and
F. Prior to closing down the construction project for a
period exceeding one week due to weather conditions or other cause.

The Plan and Zoning Commission, or an authorized agent thereof, including
the Town Engineer/Director of Public Works or the Zoning Administrator, may
issue a stop-work order if it is judged the construction work or a phase of
the work is not being carried out in accordance with these Regulations, the
construction plans or Town specifications or if unforeseen field conditions
are encountered for which the Town specifications or the plans are insufficient.
The order shall be withdrawn when there is compliance or adequate remedies
for field conditions approved by the Town Engineer/Director of Public Works,
or authorized agent thereof.
The construction program and/or work sequence for construction and installation
of improvements in the subdivision shall provide for at least the following:
A. Installation of soil erosion and sediment control measures
prior to commencement of any work for which such measures are required; and
B. Installation of storm drainage, sanitary sewers, water
mains and all other underground utilities located in streets prior to placement
of the gravel base course for the street.
C. The installation of the gravel base course and first
course of asphalt prior to the transfer of any lots within the subdivision
or issuance of a building permit on any of the lots.

D. The Commission, upon a vote of 3/4 of all members of the Commission, may waive the requirement of §
382-36C for the first course of asphalt for the construction of a model home(s), or model home(s) with sales offices limited to activity related to the marketing, sales and closing of homes located within the subdivision, under the following conditions:

(1) The Commission may permit the model home for a period
not to exceed one year. Upon request, the Commission may grant one extension
of such approval.
(2) There shall be safe and adequate all-weather access to
the model home, in the opinion of the Commission. This shall include, at a
minimum, the installation of the utilities and gravel base for the area to
be used to access the model home.
(3) There shall be no conveyance of the lot which contains
the model home until the utilities, gravel base course and first course of
asphalt are installed, as provided for in this section.
(4) No certificate of occupancy shall be issued until the
utilities, gravel base course and first course of asphalt are installed, as
provided for in this section.
(5) The Commission finds that there are unusual and extenuating circumstances that make it difficult to complete the road improvements necessary under §
382-36C.
