No person shall, within the Town, utilizing any vehicle, sell or offer for sale or solicit orders for the sale of ice cream or other frozen desserts, candy or other confections, soda or soft drinks, peanuts, popcorn, hot dogs or other prepared foods intended to be consumed in the open upon completion of the sale:
A. 
Within 500 feet of a public, parochial or private school yard between the hours of 8:00 a.m. and 4:00 p.m. on any day when such school is in session, or within 500 feet of a public park or playground between the hours of 9:00 a.m. and 8:30 p.m. on any day when such park or playground is open to the public.
B. 
To any minor of the age of 13 or younger, unaccompanied by an adult, when said minor is situated or standing in the traveled portion of the highway or when said minor, to the knowledge of said person, has illegally crossed the traveled portion of the highway to such vehicle.
This article shall not apply to the occupants of stores or shops within the Town, charitable bazaars or fairs, nor shall § 145-1B operate so as to prevent such person from selling or attempting to effect a sale to said minor when said minor is positioned or standing on that side of the traveled portion of the highway closest to such person's vehicle or from leaving his vehicle and walking to the opposite side of the traveled portion of the highway to where said minor is located in order to effect a sale.

Any person who shall violate any provision of this article shall be fined $25 per day, each day's continued violation constituting a separate offense.[1]
