There is hereby established the Town of Henlopen Acres Planning Commission.
The Town of Henlopen Acres Planning Commission shall consist of five
members to be appointed by the Mayor of the Town of Henlopen Acres, subject
to confirmation by a majority of the elected members of the Commissioners,
for a term of five years. The terms of the members of the Planning Commission
first appointed pursuant to this chapter shall expire as follows: one member
shall be appointed for a term of five years; one member shall be appointed
for a term of four years; one member shall be appointed for a term of three
years; one member shall be appointed for a term of two years; and one member
shall be appointed for a term of one year.
The Mayor and Town Manager shall be ex officio members of the Planning
Commission. An ex officio member may exercise all powers of the regular members
of the Planning Commission except that he shall not have a vote. No ex officio
member shall hold an office on the Planning Commission.
The Mayor, with the approval of the majority of the Commissioners, may
remove any member of the Planning Commission for a cause after a public hearing.
Vacancies occurring other than by expiration of term shall be filled for the
unexpired term by the Mayor, subject to confirmation by a majority of the
elected members of the Commissioners.
All members of the Planning Commission shall serve without compensation
but may be reimbursed for actual expenses incurred in connection with their
duties.
The Planning Commission shall elect annually a Chairman and a Secretary
from among its own members and may employ experts, clerks and such other assistants
that its fiscal appropriations may permit; fiscal appropriations are subject
to the Board of Commissioners' approval. The Planning Commission may
also appoint a custodian of its plans and records, who may be the Town Manager.
The Planning Commission shall make its own rules of procedures and determine
the times of its meetings. All meetings of the Planning Commission at which
any official action is taken shall be open to the public. All records of the
Planning Commission shall be a public record.
Any ordinance inconsistent with the provisions of this chapter is hereby
repealed.
