It is found and determined that the uncontrolled and indiscriminate use of surfboards under certain circumstances in the borough constitutes a threat to the health and safety of the inhabitants thereof, and the following regulations and controls are therefore necessary.
As used in this chapter, the following terms shall have the meanings indicated:
SURF
The area of any body of water adjoining the shoreline in which the wave action is increased or accelerated by reason of the decreasing depth of water approaching the shoreline, for purposes of this chapter to include all areas between the shoreline and the outer limits of the bar, if any, but in no instance less than 200 feet.
SURFBOARD
A device of any rigid, buoyant material exceeding three feet in length designed or suitable for the sport of surfing or surf riding.
SURFING OR SURF RIDING
The practice or sport of riding upon a surfboard in the surf.
No person shall engage in the sport of surfing or surf riding within the borough or in the surf adjoining the shoreline of the borough between the hours of 9:00 a.m. and 5:00 p.m. and between the dates of July 1 to Labor Day, inclusive, of any year except as provided in this chapter.
Surfing or surf riding may be permitted during the regulated periods at times and in areas designated by duly constituted lifeguards or by proclamation of the Mayor where, under existing conditions or for special purposes, the same may be found to be consistent with the health and safety of the public. Nothing in this chapter shall be taken to imply any obligation upon the borough to provide lifeguards or other protection for the safety of persons engaged in the sport of surfing or surf riding or that any particular areas are declared safe for the same.
A violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, § 1-15.
