There is hereby created and established in and for the Borough of Berlin the office of Borough Fire Official. The Mayor shall nominate and, with the advice and consent of Borough Council, appoint such officer, including the filling of any vacancy therein, which shall be for the unexpired term only. Such officer shall hold office during the pleasure of Borough Council, but unless sooner removed, shall hold office until December 31 of the year in which he shall have been appointed.
The Borough Fire Official shall act in an advisory capacity to the Fire Company and/or Fire Companies in the Borough of Berlin, and shall conduct such investigations as may be necessary or expedient for the purpose of eliminating, avoiding and abating fire hazards. Following his investigation and upon his recommendation, the Borough Council of the Borough of Berlin may proceed to enforce the same and abate any such fire hazard or hazards in the manner provided by law. The Borough Fire Official may, subject to and with the approval of the Borough Council of the Borough of Berlin:
A. 
Regulate the use, storage, sale and disposal of inflammable or combustible materials;
B. 
Provide for the protection of life and property from fire, explosion and other dangers;
C. 
Provide for the inspection of lands, buildings and other places and any goods and materials therein contained, and any goods, materials, crops or other products thereon, whether growing or not;
D. 
Provide for the removal or destruction of any building, wall, chimney, structure, materials, goods, crops or other similar items which are or may become dangerous to life or property or which may tend to extend a conflagration;
E. 
Perform such duties and exercise such powers as are vested in him by an ordinance of the Borough of Berlin entitled "An Ordinance Regulating the Installation and Maintenance of Gas-Burning Equipments, Oil-Burning Equipments and the Storage of Oil in Connection Therewith in the Borough of Berlin, County of Camden and State of New Jersey; Prescribing Permit Fees Therefor and Providing Penalties for Violations Thereof,"[1] and any amendments thereof or supplements thereto; and

F. 
Perform such other and related duties as may be specifically assigned to him by the Mayor and Borough Council of the Borough of Berlin.
The Borough Fire Official shall receive such salary and/or fees as may be determined by the Mayor and Borough Council by resolution, which shall be paid to him at such time or times and in such amount or amounts as may be so determined and/or shall be provided in the annual budget of the Borough of Berlin or otherwise.
