Every person who shall come into the Borough of Berlin, in the County
of Camden and State of New Jersey, from any point outside of said Borough,
whether in transit through said Borough or otherwise, and who shall be convicted
or shall have been convicted in any court of the United States of America
or in any court of any state, of the crime or offense of counterfeiting, theft,
larceny, embezzlement, forgery, obtaining money by false pretenses, obtaining
property by false pretenses, burglary, felonious assault, robbery, arson,
murder, rape, kidnapping, extortion, enticing any person for the purpose of
obtaining ransom, violation of any provision of any law of the United States
of America or of any states relating to the maintenance of a disorderly house,
bigamy, assignation or any other sex crime, the use, possession, sale, transportation
or other dealing in or with any narcotic drug, bookmaking, pool selling, keeping
a gambling resort or advertising, engaging in or maintaining a lottery, and
who enters the Borough of Berlin for the purpose of remaining in said Borough
for more than 24 hours, shall, within 24 hours after he enters said Borough,
register with the Chief of Police of the Borough of Berlin and furnish to
said Chief of Police a written statement signed by him, containing his true
name and each other name or alias by which he is or has been known, together
with a full and complete description of himself, the place of his birth and
present residence, the name or a description of each such crime or offense
or crimes or offenses of which he has been convicted, the date of his conviction
or convictions, and the name and location of each prison, reformatory or other
penal institution, if any, in which he has been confined as punishment therefor,
together with the location or address of his residence or his intended residence,
stopping place or living quarters within the Borough of Berlin, describing
the same by description and street number, if any, and a description of the
character of each such place, whether a hotel, apartment house, dwelling house
or otherwise, in such manner as to identify the same, and the length of time
during which he intends to remain or reside within the Borough of Berlin.
Every person residing within the Borough of Berlin, in the County of Camden and State of New Jersey, at the time this chapter becomes effective, who has been convicted within 10 years prior to the effective date of this chapter in any court of the United States of America or of any state, of any crime enumerated herein or in §
136-1 of this chapter, shall, within 24 hours from the effective date hereof, register with the Chief of Police of the Borough of Berlin and shall furnish to said Chief of Police, in a written statement signed by such person, all of the information required to be furnished under the provisions of §
136-1 hereof.
Every person so required to be registered under the terms of §§
136-1 and
136-2 of this chapter shall, at the time of registering with the Chief of Police of the Borough of Berlin, be photographed and fingerprinted according to the fingerprinting system of identification established by the Superintendent of the State Police of the State of New Jersey, and on the forms prescribed; said photographs and fingerprints shall be made part of the permanent records of the Police Department of the Borough of Berlin, and there shall be forwarded without delay two copies of the same, together with photographs, together with such other description as may be required, including the history of the offense or offenses committed, to the New Jersey State Bureau of Identification.
Every person so registered shall be given a card of identification signed
by the Chief of Police of the Borough of Berlin, upon which shall appear his
name, registry number, date and place of registration, a description of his
residence, the date or length of his proposed stay in. the Borough of Berlin,
and such other information as the Chief of Police of the Borough may deem necessary; such card shall be annexed to the copy of
the person's photograph; and every such person so registered shall carry with
him at all times such card of identification; any failure so to do, or any
failure to present the same when so requested by a police officer, shall be
deemed to be a violation of this chapter.
In the event that any such person so registered shall change his place
of address either within or without the Borough of Berlin, he shall, within
24 hours thereafter, notify the Chief of Police of the Borough of Berlin in
a written and signed statement of such change of address, by description and
street number, if any, in such manner as to identify the same, and he shall
present his identification card to the Chief of Police of the Borough of Berlin
in order that such change of residence may be noted thereon.
The Chief of Police of the Borough of Berlin shall cause to be made
a permanent record of all information, photographs and fingerprints required
by this chapter to be furnished to him and acquired by him; said records,
fingerprints and photographs shall at all reasonable times be open to the
inspection of any police officer.
It shall be unlawful for any person required by this chapter to register
or report, to furnish any false or fictitious address or any false or misleading
information in respect of information required to be given under this chapter,
or to fail, neglect or refuse to register or report, or to fail to permit
his photographs and fingerprints to be taken, as required by this chapter.
Nothing in this chapter shall apply to any person who has or shall have
received a full pardon for each such crime whereof he shall have been convicted,
nor after the expiration of 10 years from his conviction of any crime herein
enumerated.
Notice of the passage of this chapter, consisting of criminal registration
signs, shall be posted on all primary and secondary highways leading into
the Borough of Berlin.
Words used herein of the masculine gender, wherever used in this chapter,
shall be construed also to refer to and include the feminine gender.
Any person violating any provision in this chapter shall be adjudged
and deemed to be a disorderly person and shall be punished as provided in
and by the Disorderly Persons Law of the State of New Jersey, constituting
Revised Statutes 2A:169-1 et seq., and be subject to the penalties therein provided.
