The title of this chapter shall be the "Branchville
Health Code" and it is adopted pursuant to authority of N.J.S.A. 40:48-2.3
to 40:48-2.14 inclusive, which is hereby made part of this chapter.
The following terms, whenever used or referred
to in this chapter, shall have the following connotations:
DWELLING
Any building or structure or part thereof used and occupied
for human habitation either permanently or transiently or intended
to be so used, and includes any outhouses and appurtenances belonging
thereto or usually enjoyed therewith.
DWELLING UNIT
A group of rooms intended to be occupied by one family or
household as its home and where such family or household sleeps.
HABITABLE ROOM
A room which is designed or intended to be used for living,
sleeping, eating or cooking excluding storerooms, bathrooms, toilets,
closets, halls and spaces in attics or basements.
HEALTH OFFICER
That person appointed by the Board of Health, or upon its
failure to make an appointment, such other person as the Mayor with
the consent of the Council of the Borough of Branchville might designate,
to exercise the powers prescribed by this chapter.
OCCUPANT
Any person, including the owner or operator, living or sleeping
in a dwelling unit.
OWNER
Any person who is in actual possession of or has charge,
care or control of any property within the Borough of Branchville
as owner, executor, administrator, trustee, guardian or agent. Such
person shall be deemed or taken to be the "owner" or "owners" of such
property within the true intent and meaning of this chapter and shall
be bound to comply with the provisions of this chapter.
