It shall be unlawful for hawkers, peddlers,
transient merchants or itinerant vendors to offer for sale any kind
of goods, wares or merchandise within the Borough of Branchville without
first obtaining a license as hereinafter provided.
As used in this chapter, the following terms
shall have the meanings indicated:
HAWKER OR PEDDLER
One who goes from place to place, following the streets and
calling on house to house for the purpose of exhibiting and selling
goods, wares or merchandise to consumers.
TRANSIENT MERCHANT OR ITINERANT VENDOR
One who hires or rents a room or building fronting on a street
for the purpose of selling goods, wares, merchandise or bankrupt stock
with the intent of closing out or discontinuing the business within
a year from the date of commencement.
The license fee for hawkers or peddlers shall
be $5 per day, $25 per month and $75 per year. Every license shall
terminate at the end of the term granted.
Applications for such license shall be made
to the Borough Clerk, who, on payment of the fee, shall issue to the
licensee a badge or card which shall state the name of the person
to whom granted, his age, the fee paid, the duration of the license
and bear the signature of the Borough Clerk.
Every such licensee while engaged in selling
goods, wares or merchandise within the Borough of Branchville shall
at all times carry said license badge or card conspicuously displayed
on his coat lapel.
A transient merchant or itinerant vendor shall
pay a license fee of not more than $500 for a license which shall
continue in favor of the person to whom granted for a period of 180
days from the date the same is issued.
On payment of said license fee, the Borough
Clerk shall issue to such transient merchant or itinerant vendor a
card which shall state the name of the person, persons or corporation
to whom granted, the amount of license fee paid, duration of same
and bear the signature of the Borough Clerk, which said license card
shall at all times be conspicuously displayed in said store during
the term thereof.

The provisions of this chapter shall not apply
to those persons exempted therefrom by any statute of this state.

Any person required by this chapter to procure a license who violates its terms or fails to comply with the New Jersey Public Laws of 1931 (N.J.S.A. 45:24-1 et seq.) shall be subject to the penalties provided by §
1-15 of this Code.
