As used in this chapter, the following terms
shall have the meanings indicated:
BODY PIERCER
One who engages in body piercing, unless such activity is
practiced by an individual or establishment exempted from this chapter
pursuant to the definition of "operator" above.
BODY PIERCING
Any method of puncturing any portion of the body including
ear lobes, lips, tongue, cheeks, nipples, navel or any other parts
of the body with needles or instruments designed to puncture the skin
for the purpose of inserting earrings, rings or other foreign objects
through the skin, unless such procedure is practiced by an individual
or establishment exempted from this chapter pursuant to the definition
of "operator" above.
CERTIFICATE OF INSPECTION
Written approval from the Health Officer or his/her authorized
representative that said tattooing and body piercing establishment
has been inspected and meets all of the terms of this chapter.
HEALTH OFFICER
The appointed licensed Municipal Health Officer or his/her
authorized representative.
OPERATOR
Any individual who performs or practices the art of tattooing
or body piercing on the person of another or any individual, firm,
company, corporation, partnership or association that owns or operates
an establishment where tattooing and/or body piercing is performed,
but shall not include an individual or establishment that practices
body piercing when the primary business of said individual or establishment
is the sale of jewelry and the sterilization of the equipment used
for body piercing is by a properly functioning autoclave or any other
method approved for the sterilization of such equipment by the Sussex
County Health Department and/or the Centers for Disease Control. No
individual or establishment may claim the foregoing exemption unless
and until it obtains from the Borough of Branchville Board of Health
a written determination of eligibility therefore. The Borough of Branchville
Board of Health is authorized to make periodic inspections of the
equipment or method used by an exempt individual or establishment
to sterilize its body piercing equipment. An exemption from this chapter
is deemed suspended upon notice from the Borough of Branchville Board
of Health that it has determined that the equipment or method used
for sterilization by that individual or establishment has ceased to
function properly.
TATTOO, TATTOOED OR TATTOOING
Any method of placing designs, letters, scrolls, figures,
symbols or any marks under the skin with ink or any other substance
resulting in the coloration of the skin by the aid of needles or any
other instruments designed to puncture the skin.
