Inasmuch as the Charter of the Town of Stratford
designates the Town Attorney as the chief legal advisor of all offices,
departments and agencies of the Town and of officers and employees
of the Town in matters relating to their official powers and duties,
no attorney or other entity, other than the Town Attorney, Assistant
Town Attorneys or attorneys or entities designated by the Town Attorney
in specific instances, shall be compensated by the Town for the provision
of services or costs expended on behalf of any such department, agency,
office, board, commission, committee, officer or employee, unless
one of the following criteria exists:
A.Â
The Town Attorney has declared that a conflict of
interest exists which would render the Town Attorney's office unable
to provide representation.
B.Â
The authority to retain legal counsel has been separately
conferred upon such department, agency, board, commission, officer
or employee by an act of the Council or by the Connecticut General
Statutes.
C.Â
Such department, agency, board, commission, officer
or employee has notified the Council, in writing, of the need for
separate and independent counsel, the reason that such separate representation
is necessary, the expected duration of said services and the anticipated
fees and costs of the same, and such request has been approved by
the Council.
