No personal property owned by the Township of Pine, the
estimated fair market value of which is $1,000 or more, shall be sold except
to the highest bidder after due notice by advertisement for bids or for public
auction in one newspaper of general circulation in the Township. The advertisement
shall be published once not less than 10 days before the date set for the
opening of bids or public auction, and the date for opening bids or public
auction shall be announced in the advertisement. If after attempting twice
to receive bids or if at a public auction no bid was received, then the personal
property may be sold by the Township to any person or entity upon such terms
and at a price certified to be fair and reasonable under the circumstances
by both the Township's Manager and the director of the administrative department
of the Township which previously utilized such property.
No further action of the Board of Supervisors shall be
required, but such sale and its terms shall be publicly announced at the next
following regular or special meeting of the Board of Supervisors.
Personal property owned by the Township with an estimated
fair market value of less than $1,000 may be sold by the Township to any person
or entity without the necessity for public advertisement or bidding or public
auction, following a certification by both the Township's Manager and the
director of the administrative department of the Township which previously
utilized such property that the terms and price proposed is fair and reasonable
under the circumstances.
No further action of the Board of Supervisors shall be
required, but such sale and its terms shall be publicly announced at the next
following regular or special meeting of the Board of Supervisors.
