No person shall, within the Borough right-of-way,
obstruct any sidewalk, street or public place, but this section shall
not prevent persons who are building from occupying such portion of
the sidewalk, street or public place designated in a permit therefor
first obtained from the Building Inspector.
No person shall, within the Borough, throw or
discard any refuse of any kind whatsoever upon any public street or
public place or discharge any sewage or waste into such places.
It shall be unlawful for any person transporting
loads within the limits of the Borough to drop or spill the contents
of the vehicle in any manner that may injure or damage the surface
of the roadways.
No person shall, within the Borough, throw any
paper or litter of any kind upon any sidewalk, street, highway or
public or private place.
For the purposes of this Part
1, the following words and phrases shall have the meanings respectively ascribed to them by this section:
LITTER
Any used or unconsumed substance or waste material which
has been discarded whether made of aluminum, glass, plastic, rubber,
paper or other natural or synthetic material including but not limited
to any bottle, can, any unlighted cigarette, cigar, match or any flaming
or glowing material or any garbage, trash, refuse, debris, rubbish,
grass clippings or other lawn or garden waste, newspaper, magazines,
glass, metal, plastic or paper containers or other packaging or construction
material.

OCCUPANT
The owner, tenant, lessee or person in charge of or in control
of or in possession of any building or premises or part thereof or
any personal property.
OWNER
The person having the legal title to lands and premises or
to personal property.
RIGHT-OF-WAY
That portion of land owned by the Borough of Oradell which
is located between two property lines wherein is located the roadway,
curbing, shade trees, utilities and sidewalk.

ROADWAY
That portion of the street lying between the curblines.
SIDEWALKS
The pavement between the curblines and property lines.
STREET
Includes the portion thereof devoted to gutters, curbs and
sidewalks.
SUPERINTENDENT OF PUBLIC WORKS
The Superintendent of Public Works appointed by the Borough
or such person as shall succeed to his office, powers or duties.
No permit authorized by this Part 1 shall be
granted except pursuant to an application therefor, in writing, signed
by the person desiring such permit or his agent, which application
shall set forth such facts as the officer authorized to grant such
permit shall require. When forms for such application are furnished
by the Mayor and Council, such permit shall be upon such forms and
shall set forth all the information required.
The officer authorized by this Part 1 to issue
any permit is also authorized to refuse the issue of any such permit
if, in his opinion, such refusal is in the interest of the public
safety, pubic convenience or public health. In case any permit shall
be refused by any such officer, an appeal from such officer's determination
may be taken to the Mayor and Council, and the Mayor and Council,
after hearing the applicant and such officer and such other evidence
as may be produced, may either direct the issuance of such permit
or sustain the refusal of the officer.
No permit granted in pursuance of the provision
of this Part 1 shall create any vested rights, but such permit may
be revoked at any time by the officer issuing it. Such revocation
may be appealed to the Mayor and Council for its final determination.
No permit authorized by this Part 1 shall be
issued until the fee therefor shall have been paid to the officer
authorized to issue such permit for the use of the Borough.
