This chapter shall be known as the "Oradell Land Development
Ordinance."
The purposes of this chapter are to establish a pattern for
land use based on the Master Plan and to guide appropriate and orderly
development which will promote the public health, safety, morals and
general welfare. To this end, procedures for submitting and acting
upon development applications and setting design standards to guide
the preparation of plans are included. This chapter is intended to
regulate the use of land within zoning districts; secure safety from
fire, flood, and other disasters; provide adequate light, air and
open space; limit and restrict buildings and structures to specified
districts according to their type and the nature and extent of their
use for trade, industry, residence, open space or other purposes;
regulate the bulk, height, number of stories and size of buildings
and other structures; avoid a conflict with neighboring municipalities,
the county and the state; establish appropriate population densities
and concentrations contributing to the well-being of persons, neighborhoods,
communities and regions and the preservation of the environment; provide
sufficient space for residential, recreational, business, commercial
and industrial uses and open space; encourage the location and design
of transportation routes which will promote the free flow of traffic
while discouraging the location of such facilities and routes which
result in congestion or blight; promote a desirable visual environment;
promote the preservation of valuable historical resources; promote
the conservation of buildings and their appearance; preserve open
space and valuable natural resources to prevent urban sprawl and degradation
of the environment through improper use of land; provide procedures
for planned developments which incorporate the best features of design
and relate the type, design and layout of residential, business, commercial,
industrial and recreational development to the particular site; encourage
coordination of various public and private procedures and activities
shaping land development and to the more efficient use of land; and
to promote the conservation of energy through the use of planning
practices designed to reduce energy consumption and to provide for
maximum utilization of renewable energy resources.
If any chapter, section, subsection or paragraph of this revision
shall be declared to be unconstitutional, invalid or inoperative,
in whole or in part, by a court of competent jurisdiction, such chapter,
section, subsection or paragraph shall, to the extent that it is not
unconstitutional, invalid or inoperative, remain in full force and
effect, and such determination shall not be deemed to invalidate the
remaining chapters, sections, subsections or paragraphs of this revision.
