It shall be unlawful for any person or any body corporate to conduct a retail food establishment as defined in and governed by N.J.A.C. 8:24-1.1 et seq., Sanitation in Retail Food Establishments and Food and Beverage Vending Machines, without first having procured a license from the local Board of Health so to do or without complying with any or all of the provisions concerning operation and maintenance of the same as contained in the aforementioned N.J.A.C. 8:24-1.1 et seq. (See §
288-11 for violations and penalties hereof.)
The fees for licensure of retail food establishments are set forth in Chapter
170, Licenses and Fees.
No provision of this article shall be applied
so as to impose any unlawful burden on either interstate commerce
or any activity of the state or federal government.

A. Any person, firm or corporation who or which shall violate any of the provisions of this article, except as provided in §
288-11B, shall, upon conviction, be punished by a fine of not less than $200 nor more than $500 or by imprisonment in the County Jail for a period not to exceed 90 days, or by both such fine and imprisonment, and each violation of any of the provisions of this article and each day the same is violated shall be deemed and taken to be a separate and distinct offense.
B. Payment through Violations Bureau. If you wish to plead guilty to violating or refusing to comply with §
288-7, and give up your rights to have a lawyer and a trial, you may pay a fine of $200 by bringing or mailing the summons together with payment within 14 days of notice of violation to the Violations Bureau located at:
