This chapter shall be known and may be cited as the "Land Use and Development Regulations of the Township of Wall."
This chapter is adopted pursuant to the authority provided by the Municipal Land Use Law, Chapter 291, Laws of New Jersey 1975 (N.J.S.A. 40:55D-1 et seq.).
The intent and purpose of this chapter is to exercise the authority delegated to municipalities under N.J.S.A. 40:55D-1 et seq. to regulate development and to promote good planning practices. The intent of the chapter is:
A. 
To guide the appropriate use or development of all lands in the Township, in a manner which will promote the public health, safety, morals, and general welfare;
B. 
To secure safety from fire, flood, panic and other natural and man-made disasters;
C. 
To provide adequate light, air and open space;
D. 
To ensure that the development of the Township does not conflict with the development and general welfare of neighboring municipalities, the county and the state as a whole;
E. 
To promote the establishment of appropriate population densities and concentrations that will contribute to the well-being of persons, neighborhoods, communities and regions and the preservation of the environment;
F. 
To encourage the appropriate and efficient expenditure of public funds by the coordination of public development with land use polices;
G. 
To provide sufficient space in appropriate locations for a variety of residential, recreational, industrial, and commercial uses and open space, both public and private, according to their respective environmental requirements in order to meet the needs of all the citizens of the Township;
H. 
To encourage the location and design of transportation routes which will promote the free flow of traffic while discouraging location of such facilities and routes which result in congestion or blight;
I. 
To promote a desirable visual environment through creative development techniques and good civic design and arrangements;
J. 
To promote the conservation of historic sites and districts, open space, energy resources and valuable natural resources and to prevent urban sprawl and degradation of the environment through improper use of land;
K. 
To encourage planned developments which incorporate the best features of design and relate the type, design, and layout of residential, commercial, and recreational development of the particular site;
L. 
To encourage senior citizen community housing and affordable housing of various types for low and moderate income households;
M. 
To encourage coordination of the various public and private procedures and activities shaping land development with a view of lessening the cost of such development and to the more efficient use of land;
N. 
To promote utilization of renewable energy sources; and
O. 
To promote the maximum practicable recovery and recycling of recyclable materials from municipal solid waste.
In the application and interpretation of this chapter, all provisions hereof shall be held to be minimum standards or requirements adopted for the promotion of the public health, safety, convenience, and general welfare of the Township. Whenever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, the most restrictive or those imposing the higher standard shall govern.
Chapter XIV, Land Use Procedures; Chapter XV, Zoning, Chapter XVI, Site Plan; and Chapter XVII, Land Subdivision, are hereby repealed. Any other ordinance of the Township of the Revised General Ordinances of the Township of Wall, 1977, as amended and supplemented, which contains provisions inconsistent with this chapter are hereby repealed to the extent of such inconsistency of such ordinance, permit or approval; provided, however, that any building permit, variance, special use permit, conditional use permit, or other permit validly issued pursuant to any such ordinance shall remain valid and effective and shall continue to be governed by the terms and conditions of such ordinance.
A. 
This chapter shall take effect on January 1, 2004.
B. 
After the effective date of the ordinance adopting this chapter, all new applications for development and all pending applications which have not been granted preliminary approval shall be subject to the provisions of this chapter.
