The owner or tenant of lands lying within the limits of the Township is hereby required to keep all brush, hedges or other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways cut to a height of not more than 2 1/2 feet.
Where it shall be necessary and expedient for the preservation of public safety, the Township Committee shall cause notice to be served upon the owner or tenant of any lands to cut any brush, hedges or other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways to a height of not more than 2 1/2 feet, requiring such owner or tenant to cut the same within 10 days after such notice, and in the event such owner or tenant shall have refused or neglected to cut the same in the manner and within the time provided above the Township Committee shall authorize the same to be cut as aforesaid.
In the event that it becomes necessary for the Township Committee to authorize the cutting of such brush, hedges and other plant life, the same shall be done under the direction of the road foreman, who shall certify the cost thereof to the Township Committee, which shall examine the certificate and, if found correct, shall cause the cost as shown thereon to be charged against the lands, or in the event that such cost is excessive, to cause the reasonable cost thereof to be charged against the lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form a part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as other taxes and to be collected and enforced by the same officers and in the same manner as taxes.
Where the growth of brush, hedges and other vegetation creates a restriction of site distance along county roadways within the Township, the County of Monmouth is hereby designated as an officer of the Township and is empowered to cut any brush, hedges or other plant life growing within 10 feet of any county roadway and within 25 feet of the intersection of two county roadways to a height of not more than 2 1/2 feet. The cost of cutting any brush and hedges pursuant to this section shall not be levied against the affected property owners.
