A joint municipal authority is hereby authorized
to be created with the City of Butler in accordance with the Municipality
Authorities Act of 1945, as amended.
The Authority shall be designated and named
the "Butler Transit Authority."
The purpose of the Authority is to provide municipal
transportation services in the City of Butler and Township of Butler,
including the leasing and/or purchasing of real and/or personal property
necessary for the rendering of said services, the employment of such
persons as necessary for the rendering of such services and to do
and perform all acts necessary for the rendering of said services.
A. The Articles of Incorporation for the Butler Transit
Authority are modified to authorize the Authority to provide by contract
fixed route scheduled transportation services to the Clearview Mall.

B. The Butler Transit Authority shall be authorized to
provide by contract with the County of Butler, a flexible fixed route
mass transit service between points located in Butler Township and
Butler City and points situated along Pennsylvania Route 68; points
in Harmony Borough, Butler County; Zelienople Borough, Butler County;
Cranberry Township, Butler County; and Northway Mall, Allegheny County.

C. The Articles of Incorporation for the Butler Transit
Authority shall be modified as follows:

(1) The Butler Transit Authority is hereby authorized
to provide mass transportation/bus service throughout the County of
Butler.
(2) Any services provided in any area other than the Township
of Butler or the City of Butler shall be under and subject to the
following conditions and restrictions:
(a) Any service shall be provided by contract or similar
agreement between the Authority and any municipality or other entity
requesting service;
(b) The total cost of providing the service shall be paid
solely by the municipality, entity or from state/federal funds provided
solely for the requested service;
(c) Neither the Authority, Butler Township, the City of
Butler nor the County of Butler shall be liable for any expenses,
costs or cost of providing any service outside of the Township or
the city;
(d) Any municipality or other entity requesting service
shall indemnify, defend and hold the Authority, the Township of Butler,
the City of Butler and the County of Butler harmless from any claim,
demand, suit, action, cause of action, liability, expense or cost,
including all reasonable attorney's fees and costs incurred arising
from or related in any manner to the service provided by the Authority;
(e) No municipality in which services are provided shall
be entitled to representation on the Authority's board.
The Board of Commissioners of the Township of
Butler and the City Council of the City of Butler are authorized to
jointly file Articles of Incorporation with the Secretary of the Commonwealth
in accordance with the Municipality Authorities Act of 1945. Said Articles of Incorporation are to be executed on behalf
of the Township of Butler by the President of the Board of Commissioners,
attested by the Township Manager and on behalf of the City of Butler
by the Mayor, attested by the City Clerk.
