Certain documents, copies of which are on file
in the office of the Town Clerk, being marked and designated as the
BOCA Basic Fire Prevention Code, 1970, First Edition, and any additions
or annual supplements which may be forthcoming, as published by the
Buildings Officials Conference of America, Inc., be and are hereby
adopted as the Fire Prevention Code of the Town of Johnston, Rhode
Island, for the purpose of establishing standards with respect to
precautions against origin and spread of fire, smoke, noxious gases
and similar hazards arising from the use of buildings or structures;
the proper use and maintenance of exitways and all appurtenances thereto;
fire protective devices and the practice of safety measures and precautions
in the storage, handling and use of hazardous substance materials
and devices, as herein provided; and each and all of the regulations,
provisions, penalties, conditions and terms of the BOCA Basic Fire
Prevention Code, 1970, First Edition, and any additions or supplements
which may be forthcoming, are hereby referred to, adopted and made
a part hereof, as if fully set out in this article.

A. The Fire Department shall issue permits and collect
fees for the following:
(1) Inspection of removal of all underground tanks.
(2) Inspection of installation of all new underground
tanks.
(3) Pressure check of piping and new underground tank
installations.
(4) Initial inspection of smoke/heat/carbon monoxide detectors
for both commercial and residential buildings.
(5) Reinspection of smoke/heat/carbon monoxide detectors.
B. The fee for the above-itemized Subsection
A(1) through
(3) is $100.
C. The fee for the above-itemized Subsection
A(4) and
(5) shall be as dictated by the current Rhode Island State Law pertaining to the same.
D. All plan review fees shall be made payable to the
Johnston Fire Department and shall be deposited into a restricted
receipt account for use by the Johnston Fire Department. Any and all
expenditures from this account shall be approved by the Johnston Town
Council. Use of this account shall not be limited to expenses of the
Johnston Fire Department, and it may be used for additional expenditures
with specific approval of the Johnston Town Council.

E. Fee rates shall be reviewed annually by the Fire Prevention
Officer and Chief of the Department to determine if new and/or amended
fee rates are appropriate. If so they shall be submitted to the Town
Council for consideration.
In administering this Fire Prevention Code as
adopted herein, it shall be required of the Chief of the Bureau of
Fire Prevention to review applications for new business licenses,
and applications for the renewal of the business licenses. It shall
also be required of the Chief of the Bureau of Fire Prevention to
review applications for building permits and to require that one set
of building plans for all new construction be filed with the Bureau
of Fire Prevention.
When any provision of this code is found to
be in conflict with the General Laws of Rhode Island, Chapters 28.1
to 28.28, inclusive, of Title 23 as enacted by the Public Laws, 1966,
Chapter 216, entitled "Fire Safety Code," effective February 1, 1968,
and as hereafter amended, the provision which established the higher
standard for the promotion and protection of the safety and welfare
of the public shall prevail.
Nothing in this article or in the Fire Prevention
Code hereby adopted shall be construed to affect any suit or proceeding
impending in any court or any rights acquitted or liability incurred
on any cause or causes of action acquired or existing under any act
or ordinance hereby repealed, nor shall any just or legal right or
remedy of any character be lost, impaired or affected by this article.
