Territory annexed to the City and the dates
thereof as follows:
A. All that part of the E 1/2 of the SE 1/4 of Section
(25), Township (28) North, Range (19) East, lying south of the Main
River Road (now known as the Stiles Road).

B. Part of the Southeast Quarter of the Northeast Quarter
(SE 1/4 of NE 1/4) of Section (25), Township (28) North, Range (19)
East, described as follows: Commencing at the Northeast Quarter aforesaid,
thence southerly along the west line thereof 646.16 feet more or less
to a point which is also the southeast corner of Lot (8), Block (5),
George W. Volk's Addition to the City of Oconto Falls. This shall
be the place of beginning. Thence northerly along the west line of
the Southeast Quarter of the Northeast Quarter aforesaid 180 feet,
thence easterly at right angles 120 feet, thence southerly at right
angles 210 feet, thence westerly at right angles 120 feet, thence
northerly at right angles 30 feet to the place of beginning.

C. The south thirty (30) feet of the Northeast Quarter
of the Southeast Quarter (NE 1/4 of SE 1/4), Section (23), Township
(28) North, Range (19) East. That part of the Northeast Quarter of
the Southeast Quarter (NE 1/4 of SE 1/4), Section (23), Township (28)
North, Range (19) East, Oconto County, Wisconsin bounded and described
as follows: Commencing at the southeast corner of said quarter-quarter
section; thence north along the east line of said quarter-quarter
section 530 feet; thence west, parallel with the south line of said
quarter-quarter section, 592.42 feet; thence south, parallel with
the first course of this description, 530 feet to the south line of
said quarter-quarter section; thence east 592.42 feet to the place
of beginning.

D. The north 60 acres of the following described eighty-acre
tract: The Southeast Quarter of the Northwest Quarter and the Northeast
Quarter of the Northwest Quarter all in Section (35), Township (28)
North, Range (19) East, together with a parcel 30 feet wide (east
and west) extending along the west side of the south 20 acres of the
eighty-acre tract hereinbefore described.

E. That part of the Southeast Quarter of the Northeast
Quarter of Section (25), Township (28) North, Range (19) East, in
Oconto County, Wisconsin, bounded and described as follows: Commencing
at an iron pipe marking the northwest corner of the Southeast Quarter
of the Northeast Quarter of said Section (25); thence southerly on
the west line of said Southeast Quarter of the Northeast Quarter 33
feet to the place of beginning; thence continuing along this west
line 432.84 feet; thence at right angles to the left 120 feet; thence
at right angles to the right 210 feet; thence at right angles to the
right 120 feet; thence at right angles to the left and continuing
southerly along the west line of said SE 1/4 of the NE 1/4 some 644
feet to the south line of said SE 1/4 of the NE 1/4; thence easterly
along this south line 300 feet; thence at right angles to the left

F. That there be annexed to the City of Oconto Falls
from the Town of Oconto Falls the following described highway premises,
presently owned by the City of Oconto Falls, and that the same become
effective immediately upon the passage hereof: That portion of a former
town road, being a southeasterly extension of Main Street of the City
of Oconto Falls from its present terminus to its intersection with
the easterly boundary of the Town of Oconto Falls.

G. That part of the Northeast Quarter of the Southeast
Quarter and the Southeast Quarter of the Southeast Quarter of Section
25, Township 28 North, of Range 19 East, in Oconto County, Wisconsin,
bounded and described as follows: Commencing at the southeast corner
of the said Northeast Quarter of the Southeast Quarter, thence westerly
along the one-sixteenth line 24.75 feet to the west line of a town
road and the place of beginning; thence northerly along the said west
line 318 feet; thence westerly, parallel to the south line of the
said Northeast Quarter of the Southeast Quarter, to the west line
of the said Northeast Quarter of the Southeast Quarter; thence southerly
along the said west line of the Northeast Quarter of the Southeast
Quarter to the northeasterly line of Main Street; thence southeasterly
along the said northeasterly line of Main Street to the west line
of a town road, said west line being located 24.75 feet west of the
east line of the said Southeast Quarter of the Southeast Quarter;

28 North, Range 19 East, Oconto County, Wisconsin, excepting the south
30 feet of the above description and the rectangular parcel in the

Mid-Central Tool Company. All of the NW 1/4 of the SW 1/4, all of
the NE 1/4 of the SW 1/4 lying west of the easterly boundary of Caldwell
Avenue extended north, and the southerly 100 feet of the NE 1/4 of
the SW 1/4 lying east of the east boundary of Caldwell Avenue extended

corporation, having its principal office located at P.O. Box 9, Oconto
Falls, Wisconsin, having petitioned the Common Council for direct
annexation of property to the City of Oconto Falls, as the sole owner
of such property and that there are no residences located upon said
property, such property being described as follows: All of that portion
of the NW 1/4 of the SE 1/4 of Section 23, Township 28 North, Range
19 East, located northeasterly of State Highway 22 except for the
railroad right-of-way, more particularly described as follows: That
part of the Northwest Quarter of the Southeast Quarter of Section
23, Township 28 North, Range 19 East, Town of Oconto Falls, Oconto
County, Wisconsin, described by: Commencing at the northeast corner

St. Paul Eastern Grand Trunk Railway Company (now the Chicago and
Northwestern Transportation Company), as said main track center line
was originally located and established over and across said Section
23; on the northwest by a line drawn at right angles to said original
main track center line at a point thereon distant 3,808 feet southeasterly
from its intersection with the north line of said Section 23; on the
northeast by a line parallel with and distant 8.5 feet southwesterly,
measured at right angles and radially, from the center line of the
main track of the Chicago and Northwestern Transportation Company,
as said main track is now located; and on the southeast by the northwesterly
line of Highland Avenue; excluding and except any land which should

L. That the NW 1/4 of the NE 1/4 of Section 35, Township
28 North, Range 19 East, owned entirely by the City of Oconto Falls,
is hereby annexed to the City of Oconto Falls as part of the First
Ward thereof and that it shall be zoned for special purpose, being
that of a landfill.

79, and except right-of-way grant to Michigan Wisconsin Pipeline Company
in Vol. 249 of Records, Page 135, and except deed to Town of Oconto
Falls for town road purposes.
(2) Parcel No. 2: The SW 1/4 of the NW 1/4 of Sec. 24,

(4) This ordinance shall be published as provided by law
on June 30, 2004, but, pursuant to § 66.0217(8)(c), Wis.
Stats., the annexation is effective upon passage of the ordinance
by a vote of 2/3 of all the elected members of the Common Council.
Q. Territory Annexed. (Direct annexation) In accordance with § 66.0217
of the Wisconsin Statutes and the petition for direct annexation filed
with the city clerk on the 19th day of February, 2014, signed by all
owners of the land in area in the territory, the following described

(1) Effect of annexation. From and after the date of this ordinance the
territory described in this subsection shall be a part of the City
of Oconto Falls for any and all purposes provided by law and all persons
coming or residing within such territory shall be subject to all ordinances,
rules and regulations governing the City of Oconto Falls.
(2) Temporary zoning classification.
(a)
Upon recommendation of the Plan Commission, the territory annexed
to the City of Oconto Falls by this ordinance is temporarily zoned
as follows, pursuant to § 66.0217(8)(a) of the Wisconsin
Statutes: Multiple- Family (R-2).
(b)
The Plan Commission is directed to prepare an amendment to the
Zoning Ordinance setting forth permanent classifications and regulations
for the zoning of the annexed area and to submit its recommendations
to the council not later than June 1, 2014.
(3) Ward designation. The territory described in this subsection is hereby
designated as Ward 6 and added to Aldermanic District 3 of the City
of Oconto Falls, subject to the ordinances, rules and regulations
of the City of Oconto Falls governing wards.
(4) Severability. If any provision of this ordinance is invalid or unconstitutional,
or if the application of this ordinance to any person or circumstances
is invalid or unconstitutional, such invalidity or unconstitutionality
shall not affect the other provisions or applications of this ordinance
which can be given effect without the invalid or unconstitutional
provision or application.
(5) Payment to Town. Pursuant to § 66.0217(14), Wis. Stats.,
the Common Council agrees to pay annually to the Town of Stiles, for
five years, an amount equal to the amount of property taxes that the
Town levied on the annexed territory, as shown by the tax roll under
§ 70.65 Wis. Stats., in 2014.

(2) Effect of annexation. From and after the adoption of and publication of this ordinance, the territory described in Subsection
R(1) shall be detached from the Town of Stiles, Oconto County, Wisconsin and made part of the City of Oconto Falls for any and all purposes provided by law and all persons coming and residing within such territories shall be subject to all ordinances, rules and regulations governing the City of Oconto Falls.
(3) Required filings. The City Clerk shall file immediately with the
Secretary of State a certified copy of the ordinance, with a copy
of the petition and plat of survey (Exhibit A) and the legal description
and the City Clerk shall send one copy to each company that provides
any utility service in the area that is attached. The City Clerk shall
also record the ordinance with the Register of Deeds and file a signed
copy of the ordinance with the clerk of any affected school district.
The Clerk's certificate shall include reference to the population
of the territory being attached as set forth in the petition, which
population is zero persons.
(4) Municipal boundary review. The petition for annexation is located
in Oconto County, that has a population under 50,000 and therefore
a municipal boundary review is not required by the Wisconsin Department
of Administration. Oconto County's population is 38,965 as of
April 1, 2020, census data.
(5) Severability. If any provision of this ordinance is invalid or unconstitutional,
or if application of this ordinance to any person or circumstance
is invalid or unconstitutional, such unconstitutionality shall not
affect other provisions or obligations of this ordinance which can
be given effect without the invalid or unconstitutional provision
or application.
(6) Effective date. This ordinance shall be effective upon passage and
publication as required by law and the Zoning Administrator is hereby
directed to make necessary changes to the Zoning Maps forthwith. The
City Clerk is hereby directed to make necessary changes to the Election
Map forthwith and file the changes with the Wisconsin Election Commission.
