Prior to the filing of an application for the approval of a preliminary plat or certified survey map, it is recommended that the subdivider consult with the Plan Commission or the Village Engineer in order to obtain its or his advice and assistance. This consultation is intended to inform the subdivider of the purpose and objectives of these regulations, other provisions of this Code, sewer and water availability, other engineering considerations, and duly adopted Village plans and to otherwise assist the subdivider in planning his development. In so doing, both the subdivider and the Plan Commission may reach mutual conclusions regarding the general objectives of the proposed development and its possible effects on the neighborhood and the community. The subdivider will also gain a better understanding of the subsequent required procedures.
A. 
Before submitting the final plat for approval, the owner shall prepare and submit a preliminary plat. The subdivider shall file with the Village Administrator an application in writing for the tentative approval of the preliminary plat along with 10 copies of the plat. This submittal shall be made at least seven days in advance of a regularly scheduled Plan Commission meeting. The Village Plan Commission meets on the second and last Tuesday of the month. A preliminary plat submittal will require a minimum of two Plan Commission meetings for review and approval or rejection.
B. 
The preliminary plat shall be checked and reviewed as to its conformity to the Comprehensive Plan, Official Map, and the principal standards and requirements set forth in this chapter.
C. 
A public hearing shall be held at a time set by the Plan Commission regarding the preliminary plat where interested parties will be given an opportunity to address the Commission. The notice of the public hearing shall be published as a Class 2 notice in the official newspaper.
D. 
After hearing the comments at the public hearing, review of the preliminary plat or map, and conferences with the subdivider on any changes deemed advisable, and the kind and extent of public improvements which will be required, the Plan Commission shall within 60 days of submission approve, conditionally approve, or reject the plat.
E. 
If the Plan Commission rejects the plat or map, it shall return it to the owner. If it approves or conditionally approves the plat or map, it shall so notify the Village Board.
F. 
If the Plan Commission approves the preliminary plat, the Village Board shall, within 90 days of the date the plat was filed with the Village Administrator, approve conditionally or reject such plat and shall state in writing any conditions of approval or reasons for rejection, unless the time is extended by mutual consent of the Village and the subdivider. Failure of the Village Board to act within 90 days, or extension thereof, shall constitute an approval of the preliminary plat. The Administrator shall communicate to the owner the action of the Village Board. If the plat or map is approved, the Administrator shall endorse it for the Village Board.
A. 
Simultaneously with the filing of the final plat or map, the owner shall file with the Village Administrator four copies of the final plans and specifications of public improvements required by Article IV of this chapter. If the plat has not been certified by the state agencies under § 236.12(6), Wis. Stats., then copies as required by § 236.12(2), Wis. Stats., shall also be provided.
B. 
The Village Administrator shall forward the plat or map and plans and specifications of public improvements to the Plan Commission.
C. 
The Plan Commission shall refer the final plat and final plans and specifications of public improvements to the Village Engineer for review.
D. 
The Village Engineer shall examine the plat and final plans and specifications of public improvements for technical details and, if he finds them satisfactory, shall so certify in writing to the Plan Commission.
E. 
If the plat or the plans and specifications are not satisfactory, the Village Engineer shall return them to the owner and so advise the Plan Commission.
F. 
If the plat and plans and specifications of public improvements are satisfactory to the Plan Commission, it shall so certify in writing to the Village Board. If they are not satisfactory to the Plan Commission, they shall be rejected in writing and returned to the owner.
G. 
When the Village Board receives the approved plat or map and plans and specifications from the Plan Commission, it shall signify its action by motion or resolution. If rejected, the Administrator shall so notify the owner in writing; if approved, the Administrator shall endorse the plat or map as required by Ch. 236, Wis. Stats., and return it to the owner for recording.
H. 
The approval of the final plat or map by the Village Board shall constitute acceptance of the dedication of any public street, open space, or other public areas shown thereon.
I. 
If the final plat conforms substantially to the layout shown in the preliminary plat as approved, including any conditions of that approval, it shall be approved by the Village Board. The Board shall approve, conditionally approve, or reject such map within 60 days from the date when the Village receives all information requested as a condition of the approval of the preliminary plat. If the map is rejected by the Board, the reason shall be stated in the minutes of the meeting and a written statement supplied to the subdivider upon request. If the final plat is not submitted within 24 months of the last required approval of the preliminary plat, any approving authority may refuse to approve the final plat. If recommended by the Plan Commission, and if permitted by the Village Board, the final plat may constitute only that portion of the approved preliminary plat which the owner proposes to record at that time.[1]

A. 
When it is proposed to divide land into at least two but no more than four parcels or building sites, the subdivider shall prepare a certified survey map in accordance with this chapter and shall file 10 copies of the map with the Village at least 10 days prior to a regularly schedule Plan Commission meeting.
B. 
The Administrator shall transmit the copies of the map to the Plan Commission.
C. 
The Plan Commission shall transmit a copy of the map to all affected boards, commissions, or departments for their review and recommendation concerning matters within their jurisdiction. Their recommendations shall be transmitted to the Plan Commission within 10 days from the date the map is filed. The map shall be reviewed by the Plan Commission for conformance with this chapter and all ordinances, rules, regulations, general plan and general plan components that affect it.
D. 
If a proposed land division involves the dedication of streets or other public lands, the Plan Commission shall recommend approval, conditional approval, or rejection of the map and shall transmit the map along with its recommendations to the Village Board. The Board shall approve, conditionally approve, or reject such map within 90 days from the date of the filing of the map. If the map is rejected by the Board, the reason shall be stated in the minutes of the meeting and a written statement supplied to the subdivider upon request.
E. 
Recordation. The subdivider shall record the map with the County Register of Deeds within six months after the date of the last approval. If the subdivider fails to record the map as required in this chapter, the land division shall become null and void.[1]

A. 
Compliance required. No person, firm or corporation shall divide any land located within the extraterritorial plat approval jurisdiction of the Village of Sauk City which shall result in a subdivision, minor land division or replat as defined herein without complying with the applicable provisions of Ch. 236, Wis. Stats., the provisions of this section and, to the fullest extent allowed by Ch. 236, Wis. Stats., the requirements of this chapter.
B. 
Application required. When the land to be subdivided lies within the Village extraterritorial plat approval jurisdiction, the subdivider shall proceed as specified in this section.
C. 
Extraterritorial land division requirements. No subdivision or minor land division within the Village extraterritorial plat approval jurisdiction shall be approved by the Plan Commission or the Village Board which does not satisfy each of the following requirements:
(1) 
Each subdivision or minor land division shall comply with the minimum lot size requirements set forth in Chapter 365, Zoning, of this Code.
(2) 
No subdivision or minor land division shall be considered for approval which does not have the prior approval by the approving authorities for the town(s) and county(ies), where required by town and county ordinances or by the Wisconsin Statutes.
(3) 
The Plan Commission and/or Village Board may require placement of covenants or deed restrictions that are deemed necessary and appropriate to protect the purpose and intent of the Comprehensive Plan and this chapter. Any such restrictions or covenants shall be recorded.
(4) 
A public hearing shall be held at a time set by the Plan Commission regarding the preliminary plat where interested parties will be given an opportunity to address the Commission. The notice of the public hearing shall be published as a Class 2 notice in the official newspaper.
(5) 
After hearing the comments at the public hearing and review of the preliminary plat or map, the Plan Commission shall, within 60 days of submission, approve, conditionally approve, or reject the plat.
D. 
Incorporation of Official Map. The boundaries of the Village extraterritorial plat approval jurisdiction are as shown on the map titled the "Official Map of the Village of Sauk City Extraterritorial Plat/Land Division Approval Jurisdiction," which map is on file in the Village office and is incorporated herein by reference. This map shall be deemed amended to extend or expand the boundaries of the Village extraterritorial plat approval jurisdiction as new lands are annexed to the Village to the fullest extent authorized by applicable law.
A. 
General requirements. A preliminary plat shall be required for all subdivisions and shall be based upon a survey by a registered land surveyor. The map shall be a legible drawing at a map scale of not more than 100 feet to the inch and shall show the following information:
(1) 
Date, graphic scale, and North arrow.
(2) 
Proposed name of the subdivision.
(3) 
Name and post office address of the owner, subdivider and land surveyor preparing the plat.
(4) 
Small drawing showing the location of the land to be divided, including quarter section, township and range.
(5) 
Location and names of adjoining subdivisions and the owners of undivided lands.
(6) 
Present zoning of land to be divided and adjoining lands.
(7) 
Floodplain limits and the contour line lying a vertical distance of two feet above the elevation of the one-hundred-year recurrence interval flood.
(8) 
Location, width and names of all existing and platted streets, alleys, or other public ways and easements, railroad and public utility rights-of-way, parks, cemeteries, watercourses, drainage ditches, permanent buildings, bridges, and other pertinent data, as required by the Plan Commission, within 300 feet of the proposed division of land or of property owned or controlled by the owner.
(9) 
Water elevations of adjoining lakes or streams at the date of survey and the approximate high and low water levels thereof. All elevations shall be referred to Village datum.
(10) 
Layout, width, and approximate grades of all streets and rights-of-way, such as alleys, highways, and easements for sewers, water mains and other public utilities.
(11) 
Location, size and invert elevation of any existing sanitary or storm sewers, culverts and drainpipes; the location of manholes, catch basins, hydrants, and electrical and communication facilities, whether aerial or underground, and the location and size of any existing water and gas mains within the exterior boundaries of the plat or immediately adjacent to the tract. If no sewers or water mains are located on or immediately adjacent to the tract, the nearest such sewers or water mains which might be extended to serve the tract shall be indicated by their direction and distance from the tract, size and invert elevations.
(12) 
Approximate dimensions of and areas of all lots and parcels.
(13) 
Proposed building setback lines, if different from that required by Chapter 365, Zoning, of this Code.
(14) 
Contour lines at an interval of not more than one foot, with reference to Village datum.
(15) 
Length and bearing of the exterior boundaries of the proposed subdivision referenced to a corner established in United States Public Land Survey and the total acreage encompassed thereby.
B. 
Construction plans. As required by Articles III and IV of this chapter, the owner shall furnish with the preliminary plat or map preliminary construction plans of public improvements as may be necessary to determine that the construction is feasible. If only a portion of the preliminary plat is to be improved and submitted for final approval, construction plans and specifications need be prepared for only such portion. However, the design of public improvements shall be based on the needs of the whole area and such additional area as in the judgment of the Plan Commission is necessary.
C. 
Stormwater calculations. The subdivider shall submit to the Village, at the time of filing, a preliminary drainage plan or engineering report on the ability of existing watercourse channels, storm sewers, culverts and improvements pertaining to drainage or flood control within the subdivision to handle the additional runoff that would be generated by the development of the land within the subdivision. The design criteria for storm drainage shall be based upon information provided by the Village Engineer. Additional information shall be submitted to adequately indicate that provision has been made for disposal of surface water without any damage to the developed or undeveloped land downstream or below the proposed subdivision. The report shall also include:
(1) 
Estimate of the quantity of stormwater entering the subdivision naturally from areas outside the subdivision.
(2) 
Quantities of flow at each inlet or culvert.
(3) 
Location, sizes and grades of required culverts, storm drainage sewers and other required appurtenances.
D. 
Affidavit. The surveyor preparing the preliminary plat shall certify on the face of the plat that it is a correct representation of all existing land divisions and features and that he has fully complied with the provisions of this chapter.
A. 
A final plat of a subdivision shall comply in all respects with the requirements of Ch. 236, Wis. Stats.
B. 
Plans and specifications. Simultaneously with the filing of the final plat with the Village Administrator, or as soon thereafter as practicable, four copies of the construction plans and specifications shall be furnished for the following public improvements:
(1) 
Street grading and surfacing.
(2) 
Sanitary sewerage.
(3) 
Water mains and laterals.
(4) 
Curb, gutters, and sidewalks.
(5) 
Storm sewers and stormwater management facilities.
(6) 
Site grading and erosion control.
C. 
Deed restrictions and covenants. The Plan Commission may require that deed restrictions and restrictive covenants imposed by the subdivider be filed with the final plat.
D. 
The subdivider shall cause to be set upon the final plat arrows indicating the direction of drainage flows for each property line not fronting on a street on all parcels, as will result from the grading of the site and the construction of the public improvements, or which are existing drainage flows and will remain. The arrows shall be accompanied on the plat with the following note: "Arrows indicate the direction of drainage. Drainage patterns shall be maintained by the lot owner unless written approval for modification is obtained from the Village."
A. 
A final certified survey map of a division of land not requiring a plat shall comply in all respects with the requirements of § 236.34, Wis. Stats.
B. 
A minor subdivision created by certified survey map shall comply with the design standard and improvement requirements set forth in Articles II and IV of this chapter.
