It is the intent of the Village to ensure quality in land development and to ensure that each development pays its share of the cost of public facilities and services. The improvements prescribed in this article are required as a condition of approval of a land division. The improvements described in this article shall be installed, furnished, and financed at the sole expense of the subdivider. In lieu of construction of any of the public improvements, the owner may furnish a surety bond as provided in this chapter.
A. 
Agreement. Prior to installation of the required public improvements, the subdivider shall enter into a written contract with the Village requiring the subdivider to furnish and construct said improvements at his sole cost and in accordance with the approved plans and specifications.
B. 
Financial guarantees.
(1) 
The agreement shall require the subdivider to make an escrow deposit or, in lieu thereof, to furnish an irrevocable letter of credit, the amount of which to be equal to 1 1/4 times the Village Engineer's estimate of the total cost of the public improvements to be constructed.
(2) 
The time for completion of the work or components thereof shall be determined by the Village Board upon recommendation of the Village Engineer after consultation with the subdivider. The completion date shall be a component of the agreement.
(3) 
The subdivider shall pay the Village for all costs incurred by the Village for review and inspection of the subdivision. This includes, without limitation by enumeration, the legal, engineering and general administrative costs.
(4) 
In the event that the subdivision requires utility installation larger than would have been required by this chapter, the Village may, at the discretion of the Village Board, agree to participate in the cost of oversizing of the utility mains.
As required by Article II of this chapter, engineering plans and specifications shall be prepared for the public improvements required by this article in accordance with the standards set forth herein. Said plans shall be prepared at the subdivider's expense by a professional engineer who is registered in the State of Wisconsin, and said plans shall contain his seal. Such plans, together with the quantities of construction items, shall be submitted to the Village Engineer for his approval.
The Village Engineer shall review, or cause to be reviewed, the plans and specifications for compliance with the requirements of this chapter. If he rejects the plans and specifications, he shall notify the owner, who shall modify the plans or specifications, or both, accordingly. When the plans and specifications are corrected, the Village Engineer shall approve them in writing and so notify the Plan Commission so that it may approve the plans and specifications for transmittal to the Village Board. Upon approval of the plans and specifications, they shall become part of the developer agreement.
The following public improvements shall be designed and constructed:
A. 
Streets. Plans shall include center-line profiles, cross sections, spot elevations and typical sections as necessary to convey the design. Streets shall be constructed to the widths described for the corresponding street type in Article III of this chapter. Streets shall be bounded on each side by twenty-four-inch concrete curb and gutter. Pavement structure shall be three inches of asphaltic pavement over nine inches of crushed limestone base course. Additional subbase excavation and granular fill may be required on a case-by-case basis at the discretion of the Village Engineer.
B. 
Sanitary sewer. Plans shall include the location, sizes and profiles of mains and laterals, manhole rim and invert elevations. Design shall conform to current Department of Natural Resources code requirements.
C. 
Water main. Plans shall include the locations, sizes of mains, service laterals, valves, hydrants or other appurtenances. Hydrants, valves, curb stops, boxes and corporations shall conform to Village standards available from the Village Water Utility. Water main shall be ductile iron and shall be a minimum of eight inches in diameter.
D. 
Storm sewer. The locations, sizes, profiles, rim and invert elevations shall be shown for all storm sewer pipes and structures. Where open swales are proposed, profiles and cross sections shall be provided. Smooth-walled, high-density polyethylene pipe with watertight joints may be used; however, in some circumstances the Village may require that reinforced concrete pipe be provided.
E. 
Erosion control. Plans shall show erosion control structures and practices necessary to prevent erosion, sedimentation and off-site tracking in accordance with State of Wisconsin Best Management Practices.
F. 
Site grading. Plans shall show existing and proposed grades and spot elevations and foundation elevations as required by the Village Engineer.
G. 
Sidewalks. At a minimum, sidewalks shall be placed on one side of every street. The Village standard is on the west side of north-south streets and on the north side of east-west streets. The Village reserves the right to require sidewalks on both sides in areas where density and projected pedestrian traffic warrants additional walks. Sidewalks shall be concrete, a minimum of four feet wide and four inches thick. The Village may require additional width on sidewalks in areas of higher anticipated pedestrian traffic.
H. 
Streetlights. The subdivider shall install streetlights along all streets proposed to be dedicated. Such lights shall be placed at each street intersection and at such interior block spacing as may be required by the Village Board. Streetlight materials shall conform to standards utilized by the Village Electric Utility unless otherwise approved by the Village Board.
I. 
Street signs. The subdivider shall install along all streets to be dedicated a street sign of a design approved by the Village Board.
J. 
Other utilities. The subdivider shall cause gas, electrical power, cable television and telephone facilities to be installed in such a manner as to make adequate service available to each lot in the subdivision.
Additional improvements, reasonable in nature, may be required by the Village even though the same are not herein specified. Such improvements shall be installed in accordance with the plans and specifications approved by the Village Engineer.
All improvements shall be installed by contractors qualified to perform work in the State of Wisconsin and approved in advance by the Village Engineer.
All improvements constructed under this chapter shall be of the standards, where applicable, established by the State of Wisconsin Department of Transportation Standard Specifications for Highway and Structure Construction. Where the State of Wisconsin specifications do not apply, the standards shall be as approved by the Village Engineer.
It shall be the responsibility of the subdivider to secure all required permits necessary for the construction of the improvements.
A. 
Upon notification by the Village Administrator that the final plat or certified survey map has been approved by the Village Board, and upon execution of the developer agreement, the owner shall cause to be constructed and installed any required public improvements.
B. 
In lieu of Subsection A of this section, and with the approval of the Village Board, the owner may post with the Village cash, negotiable securities, or a surety bond running to the Village, in value sufficient to cover the full estimated cost as certified by the Village Engineer, to assure the satisfactory installation of the improvements as outlined in this article and contained in the plans and specifications. The surety bond shall be approved by the Village President and Village Board.
C. 
Prior to starting any of the work covered by the plans approved in § 350-25 of this article, written authorization to start the work shall be obtained from the Village Engineer upon receipt of all necessary permits and in accordance with the construction methods of this article.
D. 
Construction of all improvements required by this chapter shall be completed within two years from the date of approval of the preliminary plat by the Plan Commission, unless agreed upon otherwise as a part of the developer agreement.
E. 
During the course of construction, the Village Engineer shall make such inspections as he deems necessary to ensure compliance with the plans and specifications as approved. The owner shall pay the actual cost incurred by the Village for such inspection. This fee shall be the actual cost to the Village of inspectors, engineers, and other parties necessary to ensure satisfactory work.
After completion of all public improvements and prior to final acceptance of the improvements, the subdivider shall make or cause to be made a map showing the actual location of all valves, manholes, stubs, sewers and water mains, and such other facilities as the Village Engineer shall require. If the engineering plans for the project are prepared in a computer format, then the record drawings shall also be prepared in a computer format and presented to the Village in such format. The presentation of the map shall be a condition of final acceptance of the improvements and release of the surety bond assuring their completion.
The owner shall provide a surety bond running to the Village for a period of one year after completion of construction, in the amount of 20% of the cost of the improvements, to guarantee workmanship and materials of construction and to save the Village harmless from the cost to repair or replace the improvements.
