At the time of sale, transfer or assignment
or in the event of mortgage, pledge or hypothecation of any interest
in real property situated in the Township of Penn, Westmoreland County,
Pennsylvania, which said property is connected to the public sewer
system, no municipal lien certificate shall be issued by the Township
of Penn or the Penn Township Sewage Authority unless and until it
has been determined that the property in question, which is the subject
of the application for said municipal lien certificate, is in compliance
with Ordinance No. 607 of the Township of Penn.

A.
The application for a municipal lien certificate shall
be accompanied by a fee and the amount as is set forth from time to
time by resolution of the Board of Commissioners of the Township of
Penn. Said fees shall be established for the first hour of inspection
and each hour thereafter, and shall be payable to the Penn Township
Sewage Authority.
B.
Upon receipt of said application, the Penn Township
Sewage Authority shall, within 10 days of the receipt of said application,
inspect the lateral sewer connection to its public sewer system to
determine whether or not the same is in compliance with the Rules
and Regulations of the Penn Township Sewage Authority.

A.
In the event that it is determined that the aforesaid
lateral sewer connection is in violation of the Rules and Regulations
of the Penn Township Sewage Authority, the Penn Township Sewage Authority
shall, within five days of completion of said inspection, notify the
applicant of the violation(s) and the necessary repair work which
must be done in order to correct said violation(s). The applicant
shall then, prior to the issuance of the municipal lien certificate,
complete the repairs that are necessary to correct the defective condition(s)
and shall request the Penn Township Sewage Authority to inspect the
repair work which has been performed. The sanitary sewer lateral shall
not be covered by the applicant until the inspection has been completed.
B.
The Penn Township Sewage Authority shall, within 48
hours of said request, inspect said repair work and issue a certificate
of compliance to the applicant. At such time, the Penn Township Sewage
Authority shall issue a municipal no-lien certificate on a form to
be established by the Penn Township Sewage Authority.

An exemption from this article shall be for
those properties which had been determined by the Penn Township Sewage
Authority to be in compliance with the Rules and Regulations of the
Penn Township Sewage Authority within a period of three years prior
to the date of application for the municipal lien certificate; provided,
further, that no new construction has taken place upon the property
within the intervening three-year period.

The Township of Penn hereby designates the Penn
Township Sewage Authority as its authorized agent for the enforcement
of the provisions of the Rules and Regulations of the Penn Township
Sewage Authority. Further, in the event the Penn Township Sewage Authority
desires to increase the fees to be collected for said inspections,
the Penn Township Sewage Authority shall request the Township of Penn
to adopt an appropriate resolution increasing said fees.

Any person who violates any provisions of this
article shall, upon conviction thereof by summary proceedings, be
sentenced to pay a fine of not more than $1,000, plus costs, and in
default of said fine and costs to undergo imprisonment in the county
prison for a period not in excess of 30 days.
