A.
It shall be the responsibility of all persons who
hold permits to erect, construct, install, alter, service, maintain
or repair or inspect elevators and other conveyances to ensure that
such installation, service, maintenance and repair are performed in
compliance with provisions contained in the New York State Uniform
Fire Prevention and Building Code, the Village of Elmsford's Building
Code and in accordance with generally accepted standards referenced
in the New York State Uniform Fire Prevention and Building Code, as
well as ASME/ANSI standards and practices, and such person shall be
prepared to certify such compliance. This compliance includes providing
a Yale No. 2642 keyed lock for fire service functions to override
normal operating controls of the elevator or conveyance. In the event
that the provisions, standards, codes and practices stated are amended
or replaced, the new provisions, standards, codes and practices are
adopted without further revision to this section.
B.
Provisions not retroactive. The provisions of this chapter, except § 109-58C, are not retroactive. Any elevator or other conveyance shall be required to comply with the applicable code as of the date of its installation unless, upon inspection of any device covered by this chapter, the equipment is found to be in a dangerous condition, or there is an immediate hazard to those riding on or using such equipment, or if the design or the method of operation in combination with the devices utilized is considered inherently dangerous in the opinion of the Building Inspector. Any subsequent material alteration to an existing elevator or other conveyance is subject to the New York State Uniform Fire Prevention and Building Code.
C.
Within one year after the effective date of this chapter,
all elevators existing on, before or after the effective date of this
chapter shall be equipped with the following:
(1)
Emergency signaling and communication devices.
(2)
Pit access, illumination and a stop switch.
(3)
Top-of-car stop switch.
(4)
Hoistway-door locking devices and car-door or gate
electric contacts.
(5)
Standby (emergency) lighting power source and a top-of-car
electric light and convenience outlet fixture.
D.
Elevator inspection.
(1)
Frequency of inspections. All passenger elevators,
freight elevators, escalators, dumbwaiters, chairlifts and amusement
devices shall be inspected at least once a year. All such inspections
shall be performed by qualified elevator inspectors (QEI) approved
by the Building Official. Certificates of all such inspections shall
be filed with the office of the Building Inspector within 15 days
of performance of the inspection. The provisions of this section shall
not apply to elevators, dumbwaiters and amusement devices that are
inspected and approved at least once a year by any other department
or agency of the county, state or federal government.
(2)
Acceptance tests. All new, relocated and altered elevators,
dumbwaiters, moving stairways, amusement devices and special hoisting
and conveying equipment shall undergo acceptance tests and inspections
by qualified elevator inspectors (QEI) approved by the Building Official,
all at the expense and responsibility of the owner. Certificates of
such tests and inspections shall be submitted to the Building Official
within 15 days of performance thereof.
(3)
Safety tests. When requested by the Building Official,
safety tests shall be performed on elevators, dumbwaiters, moving
stairways, amusement devices and special hoisting and conveying equipment
by qualified elevator inspectors (QEI) approved by the Building Official,
all at the expense and responsibility of the owner.
