Borough of Caldwell, NJ Article V Miscellaneous Provisions

§ 26-37 Definitions.

Whenever a term is used in this chapter which is defined in Chapter 291, P.L. 1975 (N.J.S.A. 40:55D-1 et seq.), such term is intended to have the meaning set forth in the definition of such term found in said statute, unless a contrary intention is clearly expressed from the context of this chapter.

§ 26-38 Repeals.

All sections of Chapter 210, Subdivision and Site Plan Approval, Chapter 250, Zoning, or any other ordinance of the Borough of Caldwell which contains provisions contrary to the provisions of this chapter shall be and are hereby (to the extent of such inconsistency) repealed.

§ 26-39 Ordinances continued.

Pursuant to the provisions of Chapter 291, P.L., 1975, Section 81, the substantive provisions of Chapter 210, Subdivision and Site Plan Approval, Chapter 250, Zoning, and the development regulations set forth therein shall continue in full force and effect and shall be read in para materia with this chapter.

§ 26-40 Pending applications.

All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of Article IV of this chapter.

§ 26-41 Title.

This chapter shall be known and may be cited as "The Land Use Procedures Ordinance of the Borough of Caldwell."

§ 26-42 Filing with County Planning Board.

Immediately upon adoption of this chapter, the Municipal Clerk shall file a copy of this chapter with the County Planning Board as required by law. The Clerk shall also file with said County Planning Board copies of all other chapters of this Code relating to land use, such as Chapter 210, Subdivision and Site Plan Approval, and Chapter 250, Zoning.
