Unless the context otherwise requires, the meaning of terms used in this article shall be as follows:
BOD (DENOTING BIOCHEMICAL OXYGEN DEMAND)
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter.
BOROUGH
The Borough of Caldwell and, when the context requires, shall mean its Supervising Engineer or his authorized deputy, agent or representative.
INDUSTRIAL SEWER
The pipe which connects an industrial plant to the public sanitary sewer.
INDUSTRIAL WASTES
The liquid wastes from industrial manufacturing processes, trade or business, as distinct from sanitary sewage.
pH
The logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.
SANITARY SEWAGE
Normal domestic sewage from toilets, baths, showers, wash bowls and sinks, exclusive of industrial wastes or storm and surface water and drainage.
SANITARY SEWER
A sewer which carries sanitary sewage and to which storm, surface and ground waters are not intentionally admitted.
SEWAGE
A combination of the water-carried domestic wastes from residences, offices, schools, business buildings and institutions.
SEWER
A pipe or conduit for carrying sewage.
SEWERAGE WORKS
All facilities for collecting, pumping, treating and disposing of sewage.
SLUG
Any discharge (into the sewerage works) of water, sewage or industrial waste from any single user which in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than 15 minutes more than five times the average twenty-four-hour concentration or flows during normal operation.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension in water, sewage or other liquids and which are removable by laboratory filtering.
UNCONTAMINATED WATER or UNPOLLUTED WATER
Water which is free of organic, chemical or other pollutants.
No person shall discharge or cause to be discharged any stormwater, surface water, groundwater, roof runoff, subsurface drainage, uncontaminated cooling water or unpolluted industrial process waters to any sanitary sewer.
Stormwater, industrial cooling water, unpolluted process waters and all other unpolluted drainage shall be discharged to such sewers as are specifically designated as storm sewers or to a natural outlet approved by the municipality in which the industrial plant is located.
No person shall discharge or cause to be discharged any of the following described waters or wastes to any public sanitary sewers:
A. 
Any gasoline, benzene, naphtha, petroleum products, fuel oil or other flammable or explosive liquid, solid or gas.
B. 
Any waters or wastes containing toxic or poisonous solids, liquids or gases which, either singly or by interaction with other wastes, will injure or interfere with any sewage treatment process or constitute a hazard to humans or animals or create a public nuisance.
C. 
Any waters or wastes having a corrosive property capable of causing damage or hazard to structures, equipment and personnel of the sewerage works.
D. 
Solid or viscous substances in quantities, concentrations or of such size capable of causing obstruction to the flow in sewers or other interference with the proper operation of the sewerage works, such as, but not limited to, ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, feathers, tar, plastics, wood, whole blood, paunch manure, hair and fleshing and entrails; and paper dishes, cups, milk containers or other paper or plastic containers either whole or ground by garbage grinders.
No person shall discharge or cause to be discharged into the public sanitary sewer the following described substances, materials, waters or wastes if, in the opinion of the Borough of Caldwell, such wastes may cause damage to the sewers or sewerage works or have an adverse effect on the receiving stream or can otherwise endanger life, limb, health, public safety, public property or constitute a nuisance. Upon notification by the Borough of Caldwell, all persons shall immediately cease to discharge such substances into the public sanitary sewer:
A. 
Any liquid or vapor having a temperature lower than 32° F. or higher than 150° F.
B. 
Any water or waste containing fats, wax, grease or oils, whether emulsified or not, or containing substances which may solidify or become viscous at temperatures between 32° F. and 150° F.
C. 
Any waters or wastes containing acid, iron, pickling wastes or concentrated plating solutions, whether neutralized or not.
D. 
Any waters or wastes containing iron, chromium, copper, phosphates, zinc or any toxic substances whatsoever.
E. 
Any waters or wastes containing phenols or other taste or odor producing substances.
F. 
Any radioactive wastes or isotopes of such half-life or concentration as may exceed limits established by applicable state or federal regulations.
G. 
Materials which exert or cause:
(1) 
Concentrations of inert suspended solids (such as, but not limited to, Fullers earth, lime slurries and lime residues) or of dissolved solids (such as, but not limited to, sodium chloride and sodium sulfate).
(2) 
"Slugs" as defined herein.
H. 
Waters or wastes containing substances which are not amenable to treatment or reduction by the sewage treatment processes employed or are amenable to treatment only to such degree that the sewage treatment plant effluent cannot meet the requirements of other agencies having jurisdiction over discharge to the receiving waters.
A. 
If any waters or wastes which contain the substances or possess the characteristics enumerated in §§ 190-29 and 109-30 of this article are discharged by any person or are proposed to be discharged by any person to the public sanitary sewers, the Borough of Caldwell may:
(1) 
Reject the wastes.
(2) 
Require pretreatment or equalization of waste flows to a condition which conforms to the requirements of this article.
B. 
If the Borough of Caldwell permits the pretreatment or equalization of waste flows, the design, installation and operation of the pretreatment and equalization plant and equipment shall be subject to the review, approval and periodic inspection of the Borough of Caldwell and subject to the requirements of all applicable Borough, state and federal codes, ordinances and laws.
Where pretreatment or flow-equalizing facilities are provided for any waters or wastes, they shall be maintained continuously in satisfactory and effective operation by the owner at his expense.
When required by the Borough of Caldwell, the owner of any property serviced by a building sewer carrying industrial wastes shall install a suitable control manhole, together with such necessary meters, valves and other appurtenances in the building sewer, to facilitate observation, sampling and measurement of the wastes. Said manhole, when required, shall be constructed in accordance with plans approved by the Borough of Caldwell. The manhole shall be installed by the owner at his expense and shall be maintained by him so as to be safe and accessible at all times.
All measurements, tests and analyses of the characteristics of waters and wastes to which reference is made in this article shall be determined in accordance with the latest edition of Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, and shall be determined at the control manhole provided, or upon suitable samples taken at said control manhole.
If a stoppage occurs in an industrial sewer, all necessary precautions must be taken to intercept the dislodged material at the first downstream manhole and remove the same from the sewer system. This may be accomplished by the use of a metallic screen or similar device.
In addition to the requirements of §§ 190-29 and 190-30, the waste effluent from all industrial plants which are to be treated at the Caldwell Wastewater Treatment Plant must conform with the following characteristics:

A. 
All persons whose industrial waste will be treated at the Caldwell Wastewater Treatment Plant must submit an application to the Borough of Caldwell on forms to be provided by the Borough Engineer of Caldwell. Said application must be approved before any wastes are discharged into the public sewers. This provision applies with equal force and effect to all persons whose waste is being treated on the date that this article is adopted, except that such persons shall have 15 days from the date of the adoption of this article to comply.
B. 
If there is a change in the ownership or user of any industrial facility, a new application must be filed with the Borough of Caldwell within 30 days thereof.
C. 
If there is any change in the nature or volume of industrial waste to be discharged to a public sewer from any industrial facility, a new application must be filed with the Borough of Caldwell 30 days prior to such change.
D. 
An application fee in the amount required by Chapter A270, Fees, shall accompany all applications filed pursuant to this article.

E. 
If pretreatment of industrial wastes or equalization of waste flow is required under the terms of this article, the fee for the review of all plans and specifications and inspection of the construction in connection with pretreatment or equalization plants shall be the actual cost to the Borough of Caldwell of said review and inspection; provided, however, that no said fee shall be less than the amount required by Chapter A270, Fees. The fee in the amount required by Chapter A270, Fees, must accompany all plans and specifications submitted to the Borough of Caldwell for its review. Any additional fee must be paid prior to the final approval of construction of the pretreatment or equalization plant.

F. 
If any person violates any of the provisions of this article, any permits issued to said person may be revoked on 10 days' written notice from the Borough of Caldwell.
The Borough of Caldwell, its Supervising Engineer and any other duly authorized employees of the Borough of Caldwell bearing proper credentials and identification shall be permitted to enter all properties for the purposes of inspection, observations, measurement, sampling and testing in accordance with the provisions of this article.

Any person violating any of the provisions of this article shall, upon conviction, be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days, a period of community service not exceeding 90 days, or a combination thereof. Every day that such violation continues shall be deemed to be a separate offense.
