A. 
All improvements (except electric, gas and water main extensions to a privately owned utility company) shall be installed under the supervision and inspection and to the satisfaction of the Borough Engineer, the cost thereof to be borne by the developer.
B. 
In order to cover the cost of inspection, an amount equal to 4% of all improvements, as estimated in advance by the Borough Engineer and approved by the Planning Board, shall be deposited in the form of cash or certified check with the Borough Administrator before commencement of any construction. Charges for inspection services shall be in accordance with prevailing agreements between the Borough and the personnel involved. If said deposit shall be insufficient, any additional, reasonable inspection cost as approved by the Planning Board shall be paid by the developer before the improvement is accepted. Any balance from the deposit after inspection costs have been deducted therefrom shall be refunded to the developer.
No construction work relative to the installation of required improvements shall commence without the Borough Engineer or other responsible officer being notified at least 48 hours before the commencement of said work. No street underground installations shall be covered until inspected and approved by the Engineer or other authorized official.
Failure of the developer, his contractor or agents to conform to the specifications for installing improvements indicated above or to conform to the preliminary plat plan as approved by the Planning Board will be just cause for the suspension of work being performed, and no person, firm or corporation shall have the right to demand or claim damages from the Borough of Caldwell, its officers, agents or servants, by reason of such suspension.
