If, before final subdivision approval has been
obtained, any person transfers or sells, or agrees to transfer or
sell, as owner or agent, except pursuant to an agreement expressly
conditioned on final subdivision approval, any land which forms a
part of said subdivision, such person shall be subject to a fine not
exceeding $2,000, imprisonment for a term not exceeding 90 days, a
period of community service not exceeding 90 days, or a combination
thereof; and each parcel, plot or lot so disposed of shall be deemed
a separate violation. The Borough may also bring legal action to invalidate
the conveyance pursuant to law.
