The provisions of this article shall be considered
a part of the contract made with every person who takes water supplied
by the Borough, and every such person shall be considered as having
expressed his acceptance thereof.
Applications for permits for connections with
distribution pipes shall be made by the owner of the premises and
shall be signed by such owner or his authorized agent or attorney.
Not more than one house, business establishment
or other place shall be supplied from the same connection with the
street main except by special permission of the Borough Council and
under such restrictions as it may impose.
Service pipes connecting with mains and used
by private owners or occupants shall be installed at their expense.
All persons taking water shall keep the service
pipes from the mains in good repair and protected from frost at their
own expense and shall be held liable for all damage resulting from
their failure to do so.
No street washer or yard hydrant shall be connected
with the service pipe outside the building, but the pipe therefor
shall be taken from within the foundation wall and on the house side
of the meter connection.

Whenever the stopcock or box controlling the
water supply to any premises of any service pipe between the water
meter and the curbline is broken or not in serviceable condition,
the owner or consumer shall be notified at once, and if such owner
or consumer fails to remedy the defects within a reasonable time,
the water shall be shut off and not again turned on until the apparatus
has been put into serviceable condition and charges for turning on
have been paid.
After water has been cut off from any premises
for any purpose whatsoever, no person other than the authorized representative
of the Borough Council may turn such water on.
The stop at the curb shall not be used by anyone
but those authorized by the Borough Council.
Should any accident occur necessitating shutting
off the water, this shall be done by means of the stop in the service
pipe immediately after it enters the house. Such stop shall be a part
of the plumbing of every connection with the mains.

A. If any consumer wishes to discontinue the use of water
from the mains, he shall give notice, in writing, of such intention
to the Borough Tax and Water Collector. He shall be charged for the
use of water until such notice is given, at which time the meter may
be removed.
B. Owners of property which is vacant or is to become
vacant who wish to receive credit for the nonuse of water therein
shall give written notice of such vacancy to the Borough Tax and Water
Collector so that the water may be shut off. If the water is left
on during such vacancy, the customary charges shall be made, and no
such credit for nonuse shall be allowed unless such notice is given.
The Borough Council shall use all diligence
and reasonable care to provide a constant supply of water through
its pipes to consumers, but in event of breakage, failure, accident
or shutting off for extensions or repairs, the Borough shall not be
liable to any consumer for any damage resulting from the elements
or any accident, misfortune, failure or breakage of pipes or failure
of service due to any causes beyond the control of the Borough Council.

All complaints relating to water supply, distribution
and consumption may be made to the Water Operator or the Borough Council,
and if made to the Water Operator, it shall be his duty to investigate
such complaints at once and present them with his report thereon at
the next meeting of the Borough Council. It shall be the duty of the
Water Operator to report to the Borough Council any violation of the
provisions of this article.
No person shall be permitted to open any fire
plug or hydrant or draw water therefrom except the Borough Council
or those acting with its permission or under its direction. Members
of the Fire Department are authorized to use the fire plugs or hydrants
for the purpose of extinguishing fares. The Chief of the Fire Department
and his two assistants are authorized to use the fire plugs or hydrants
for the purpose of cleaning engines, hose or other Department equipment
or making trials of Department engines or hose, but all such use shall
be under the direction and supervision of the Chief or his assistants.
In no event shall an inexperienced or incompetent person be permitted
to manipulate or control in any way any fire plug, hydrant or other
fixture.
No person shall at any time obstruct free access
to any curb cock, valve, hydrant or other fixture for the control
of the public use of water in any of the streets of the Borough by
placing on, in front of or around the same any building or material.
The Borough Council shall from time to time,
by resolution, establish the water rents for the use of water supplied
by the Borough water system.

The Borough Council shall from time to time,
by resolution, establish when water meters shall be read and when
water rent shall be paid at the office of the Borough Tax and Water
Collector.

If any bill remains unpaid 30 days after it becomes due, the water supply may be turned off after five days' previous notice has been given, and the water supply shall not again be turned on until all charges have been paid, plus a fee as set forth in Chapter
A270, Fees, for restoring the service.
When so requested, the Borough shall render
bills for water to and receive payment from agents or tenants of premises
in which water is used. Notwithstanding this provision, water charges
are a lien upon the property where the water is supplied, and owners
are responsible for any delinquency in the matter of payments by tenants
or agents.

A violation of any provision of this article
shall be punishable by a fine of not more than $2,000, imprisonment
for not more than 90 days, a period of community service not to exceed
90 days, or a combination thereof.
