No person subject to Article I of this chapter shall sell or offer for sale to the general public any merchandise, by use of or from a stand, carrier, cart, motor vehicle, or other means of conveyance, while in a stationary or semi-stationary location on any sidewalk, public right-of-way, public thoroughfare, or other public property. Semi-stationary is intended to include the stopping, standing, or parking on a sidewalk, public right-of-way, public thoroughfare, or public property for a period of 15 minutes or longer.
This article does not prohibit peddlers, solicitors, canvassers, or transient merchants from selling merchandise from door to door wherein such sales are to the owners or occupiers of dwellings or buildings wherein such sales and the delivery of merchandise occurs on the private property of such owners and/or occupiers.
This article shall not apply to those instances controlled and governed by § 135-94 of Chapter 135, Land Development, regarding charitable festivals and other such activities.
Violations or failure to comply with any of the provisions of this article shall be punishable as provided in Chapter 1, General Provisions, § 1-14. Each day such a violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.
