This chapter implements provisions of P.L. 1991, c. 92[1] to require installation of at least one smoke detector on each level of one- and two-family homes when a change of occupancy occurs. The Municipal Fire Official shall have responsibility to enforce the provisions of this chapter.

A structure used or intended for use for residential purposes by not more than two households shall have a smoke-sensitive alarm device, also known as a "smoke detector," and a carbon monoxide detector installed, in addition to a portable fire extinguisher in accordance with N.J.S.A. 52:27D-198.1 and the New Jersey Uniform Construction Code.

Whenever there is a change of occupancy of any building subject to the requirements of this chapter, no owner shall sell, lease or otherwise permit occupancy for residential purposes of that building without first obtaining from the Municipal Fire Official a certificate evidencing compliance with the requirements of this chapter. The certificate will expire three months after issuance. Expired certificates will require a new application and inspection prior to change of occupancy.

A fee shall be paid to the Fire Prevention Bureau to offset the cost of the inspection and certification required by this chapter. Said fee shall be in addition to any other fees required by other ordinances in connection with inspections and certifications by any other local, county or state agency. The fee schedule shall be as follows:
A. 
Thirty-five dollars for requests received 14 days or more prior to settlement date.
B. 
Fifty dollars for requests received seven days to 13 days prior to settlement date.
C. 
Seventy-five dollars for requests received two days to six days prior to settlement date.
D. 
One hundred twenty-five dollars for requests received with less than 48 hours' notice.
E. 
Failed inspections shall require the owner to reapply for a new inspection at the original fee.

Any person(s) who is found to be in violation of the provisions of this chapter shall be subject to a penalty as specified in § 1-1 of the Township Code.
