East Brandywine Fire Company personnel (its
fire and police personnel) are authorized to participate in countywide
mutual aid, fire and emergency training schools, conventions, parades,
meetings and civic functions of the kind customarily attended by or
participated in by Chester County volunteer fire company personnel.
Fire Company personnel are authorized to assist
other county fire departments and companies and civil and community
organizations in traffic and crowd control during emergencies and
civic activities and functions.
For the duties and activities set forth and
authorized above, members of the East Brandywine Fire Company, including
necessary travel directly to and from those duties and activities,
shall be considered to be performing bona fide duties of the Fire
Company and its personnel and shall, in accordance with applicable
statutes, rules and regulations, be covered by the Township's worker's
compensation insurance for any injuries incurred in the performance
of the aforementioned duties and activities.

The purpose and objective of this article are
to recognize the East Brandywine Fire Company as the duly recognized
volunteer Fire Company for the Township, and to designate those duties
and activities which the Township shall authorize either by approval
under formal governing procedures or by approval following application
by the Fire Company to the Township for written approval, in accordance
with terms hereof, of the ancillary activities and duties which the
Fire Company desires to perform. These duties and activities are as
follows:
A. The volunteer fire company recognized by the Township
is authorized to actively engage in firefighting within the boundaries
of the Township and to respond to out-of-jurisdiction calls only pursuant
to the authorization of a duly authorized mutual aid agreement or
an agreement for first-call service approved by the municipality.
B. A volunteer fire fighter may engage only in those
acts that are recognized as fire-fighting activities. Such acts are
limited to the following activities of a firefighter while actually
engaged as a firefighter:
(1) The firefighter's act of going to or returning from
any fire which the fire company of which they are a member shall have
attended;
(2) The firefighter's participation in fire-fighting instruction
and fire drills which the fire company of which they are a member
shall have attended;
(3) The firefighter's participation in repair and or other
work on fire apparatus, buildings and grounds of the fire company
or fire department, which work is specifically authorized by the chief
of the fire company or fire department; and
(4) The firefighter's performance in responding to any
emergency call for any purpose, or while riding upon the fire apparatus
owned or used by the fire company of which they are a member.
A duly authorized volunteer fire company may
only participate in certain ancillary activities or duties after obtaining
the separate written approval of East Brandywine Township following
official action by the Board of Supervisors granting such approval.
A. Any emergency service personnel who suffer from the
lasting effect of an incident well after the emergency concludes.
Sufficient documentation must be provided to the insurance carrier
to substantiate the claim tied to a specific incident or incidents.
B. Any emergency medical provider which responding to,
on the scene of, or returning from the scene of any medical emergency.
C. Travel to and after a parade, and while engaged in
parade activities.
D. Any company member traveling to or returning from
any approved vehicle repair facility, equipment repair facility, or
while receiving new equipment or apparatus on behalf of the Fire Company.
E. Any company member while performing various authorized
fund-raising functions, including but not limited to:
(1) Chicken barbecue activities.
(2) Turkey raffle activities.
(3) Christmas tree sales and associated activities.
(5) Paper/recycling collection activities.
F. Any member of the Fire Company Auxiliary while engaged
in support of the emergency operations, including but not limited
to travel to and from the scene of the emergency.
