GENERAL REFERENCES
DUI System of Service Advisory Council — See Ch. 387.
The name of this organization shall be the "York/Adams Drug and Alcohol Planning and Implementation Council."
The York/Adams Drug and Alcohol Planning and Implementation Council serves as the instrument of the York and Adams Council Commissioners for the purpose of providing comprehensive planning, implementation and evaluation, information and referral of drug and alcohol services.
A. 
Membership on the Council shall be for a three-year appointment by York/Adams County Commissioners. Membership on the Council shall begin upon official appointment by the Joint County Board of Commissioners.
B. 
No member shall serve more than two consecutive terms.
C. 
There shall be a minimum of 11 members on the Council.
D. 
York County shall be represented by six members and Adams County by five.
E. 
Membership shall meet the following criteria as required by the Office of Drug and Alcohol Programs: criminal justice, education, health care professional, drug and alcohol service recipient and human service professional. No member shall represent more than one category. One member must be 25 years or under at the time of appointment. At least two of the members must be representatives of minority populations.
F. 
No more than 60% of the members may be of the same sex.
G. 
Resignation from the Council shall be made in writing to the Chairperson. When vacancies occur, the Council and/or Program Office shall recommend eligible candidates to the York/Adams County Commissioners for appointment.
A. 
The officers of the Council shall be a Chairperson, Vice Chairperson and a Secretary.
B. 
Duties of officers shall include the following:
(1) 
The Chairperson shall preside at all meetings; conduct business in an orderly fashion; serve as an ex officio member of all committees; appoint Chairpersons of committees; and delegate responsibility.
(2) 
The Vice Chairperson shall perform duties of the Chairperson in his/her absence.
(3) 
The Secretary shall ensure that the minutes are recorded of all meetings and shall perform the duties of the Chairperson in the absence of the Chairperson and Vice Chairperson.
C. 
A Nominating Committee shall be appointed by the Chairperson at the July meeting to report a slate of officers at the September meeting. Permissions to submit their names must be secured in advance by the Nominating Committee.
D. 
Election of the officers shall take place at the October meeting after the report of the Nominating Committee.
E. 
The term of office shall be for one year.
A. 
There shall be 10 monthly meetings of the full Council each year. The Council will not meet in August or December. Additional meetings may be called by the Chairperson or the Secretary.
B. 
Members are required to attend eight regular meetings during the Council year.
C. 
A member is considered ineligible to serve on the Council after being absent for three consecutive meetings. Illness or a prior commitment is an excused absence if the Program Office is so informed prior to the meeting. The York/Adams County Commissioners will be advised of the ineligibility of the absentee member.
D. 
The annual meeting shall be held in the fall at the discretion of the Council. This meeting is public, and announcement of such must be made two weeks prior to the meeting.
E. 
All meetings are in accordance with the Sunshine Law.[1] Notification of the meeting time and place will be published in the local newspapers 30 days in advance of each meeting.

F. 
A quorum shall consist of a majority of Council.
A. 
The Committees of the Council shall be the Executive Committee, composed of the officers of the Council, and Planning, Evaluation and Budget Committees.
B. 
The Executive Committee maintains regular communication with the Program Office and convenes to discuss special issues. This Committee shall have general supervision of the affairs of Council between the regular meetings. The Committee may be called to meet by the Chairperson. No other persons shall, without invitation from the Chairperson, be present during Executive Committee meetings.
C. 
The Planning Committee shall be responsible for assessing the needs of the York/Adams Drug and Alcohol Program. It shall also be responsible for long-range planning.
D. 
The Evaluation Committee shall review the services given by the providers as to the effectiveness in meeting the needs of the clients. This Committee shall also recommend corrective actions, if necessary, to the Executive Committee.
E. 
The Budget Committee shall oversee the budget of the York/Adams Drug and Alcohol Program Office. The Chairperson shall meet with the Administrative Assistant prior to each Council meeting to review the fiscal status. This Committee shall make recommendations for the distribution of funds.
All business of the Council shall be conducted according to Robert's Rules of Order.
These bylaws may be amended at any regular meeting of the Council by a two-thirds vote, provided that the amendment has been submitted in writing at the previous meeting.
Should any of these bylaws at any time conflict with law or the regulations of the Office of Drug and Alcohol Program, the aforesaid law and regulations shall take precedence over these bylaws until they can be amended.
