GENERAL REFERENCES

§ 138-1 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:
INOPERABLE
Incapable of being legally driven or moved under its own power on the public highways of the State of New Jersey.
MOTOR VEHICLE
Every device in, upon or by which persons or property might, if such device were in operable condition, be transported upon a highway, excepting devices moved by human power.
OPERABLE
Capable of being legally driven or moved upon the public highways of the State of New Jersey.
UNLICENSED
Not currently licensed by the proper licensing authority to be driven or moved on the public highways, or not bearing current registration plates or tags lawfully issued by the authority for the motor vehicle involved.

§ 138-2 Prohibited disposal.

A. 
No person shall leave any inoperable or unlicensed motor vehicle or any part thereof on any public road or other public lands or premises except in case of emergency and then for a period of no more than 24 hours.
B. 
No person shall leave or maintain any inoperable or unlicensed motor vehicle or any part thereof on any private lands or premises for more than 45 days, whether consecutive or not.
C. 
No owner or occupant of any lands or premises shall permit any inoperable or unlicensed motor vehicle or any part thereof to be left or maintained on his lands or premises for more than 45 days, whether consecutive or not.

§ 138-3 Exceptions.

This chapter shall not apply to motor vehicles or parts thereof located inside garages or other buildings, nor to operable but unlicensed motor vehicles displayed for sale on the premises of a licensed new or used car dealer.

§ 138-4 Violations and penalties.

Any person violating the provisions of this chapter shall be subject, upon conviction thereof, to the penalty provided for in Chapter 1, General Provisions, § 1-15.
