This chapter shall be referred to as the "Town of Newfane Noise Ordinance."
As used in this chapter, the following words shall have the meanings indicated:
PERSON
Includes natural persons, incorporations, partnerships, associations, joint-stock companies, societies and any other entities capable of being sued.
It shall be unlawful for any person to make or cause to be made or continue any unnecessary or unusual noise which would either annoy, injure or endanger the comfort, quiet, health or safety of others, whether in the operation of any machine or the exercise of any trade or calling, or otherwise any noise which either annoys, injures or endangers the comfort, quiet, health or safety of others, unless the same shall be necessary for the protection or preservation of property or for the health, safety or life of some person or as a necessary part of a lawful business during normal working hours.
It shall be unlawful for any person to operate or maintain in any home, building or on any premises, automobile, motortruck or other motor vehicle any device or loudspeaker, mechanical or otherwise, or any other device of any kind or nature where the sound therefrom causes annoyance or injury or shall endanger the comfort, quiet, health or safety of others or which is maintained for advertising purposes to attract the general public or which is so positioned or so operated that it constitutes an inconvenience or other distraction or annoyance for travelers upon any public highway or public place or for persons in any neighboring premises.
The use of loudspeakers to advertise newsworthy items, matters of public concern or athletic activities shall not be deemed a violation of this chapter, provided that a permit is obtained from the Town Clerk's office setting forth the dates, times and public purpose for which said permit is desired.
Any person who shall violate the provisions of this chapter shall, upon conviction thereof, be punished by a fine of not less than $25 nor more than $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment. Each day on which such violation continues shall constitute a separate offense.
