A. 
This chapter shall be known as the "Commercial Security Code."
B. 
The purpose of this chapter is to enhance the safety and welfare of all persons lawfully accessing during business hours retail shopping centers in the Township of Pohatcong by requiring private security patrols for larger shopping centers as defined herein below.
As used in this chapter:
OPERATOR
The owner of a shopping center and any legal entity legally authorized by the owner of the shopping center to manage, lease or operate the shopping center.
SHOPPING CENTER
Any retail establishment consisting of one or more commercial enterprises with common areas open to the public, including parking lots, sidewalks, pedestrian ways and open space, that has a total gross floor area of 125,000 square feet or more.
A. 
The operator of every shopping center shall provide not less than one uniformed security officer for the patrol of all enclosed and unenclosed areas accessible to the public, including parking lots, from one hour before opening to one hour after the close of business. The requirements of this section shall be enforceable, jointly and severally, against the owner, primary lessee(s) or management company of every shopping center.
B. 
Security personnel required pursuant to this chapter shall make periodic foot and vehicular patrols and inspections of the interior and common areas of each shopping center, including the parking areas. Vehicular patrols shall be undertaken in a motor vehicle marked and identified as a security vehicle with a flashing amber rotating light clearly visible to the general public.
C. 
Security personnel shall notify the Pohatcong Township Police Department in the event of any observed violation of law or other unlawful conduct and shall not have the authority to issue summonses or make arrests or exercise any other authority exclusively within the purview of the Township's Police Department.
The operator of each shopping center covered by this chapter shall provide the Pohatcong Township Police Department with the name, address and contact numbers for the security service and/or security officer(s) retained in compliance with this chapter.
In the event that the requisite security services shall not be provided at a shopping center in accordance with the provisions of this chapter:
A. 
Each person who shall violate any provision of this chapter shall, upon conviction, be punished by a fine of not more than $1,000 or less than $100 or imprisonment in jail for not less than 90 days, or both.
B. 
Each day upon which a violation of this chapter takes place shall constitute a separate offense.
