This chapter shall be known as the "Pohatcong Township Soil Erosion and Sediment Control Ordinance."
The purpose of this chapter is to control soil erosion and sediment damage and related environmental damage by requiring adequate provisions for surface water retention and drainage and for the protection of exposed soil surfaces in order to promote the safety, public health, convenience and general welfare of the community.
Pohatcong Township hereby turns over all regulation and enforcement of soil erosion and sediment control within the Township to the Warren County Soil Conservation District as provided in N.J.S.A. 4:24-1 et. seq.
No application for development, including subdivisions, site plans and building permits submitted to the Planning Board, Board of Adjustment or the Construction Code Official of Pohatcong Township pursuant to N.J.S.A. 40:55D-1 et seq. and the land use regulations of Pohatcong Township, shall be granted approval unless the applicant has obtained written approval of soil erosion and sediment control plan from the Warren County Soil Conservation District or a letter stating that the proposed development is exempt from the soil erosion and sedimentation control regulations.
The Soil Erosion and Sediment Control Ordinance of the Township of Pohatcong adopted on 4-18-1978, and any amendments thereto, and any other ordinance or parts of any ordinance inconsistent with the provisions of this chapter are hereby repealed.
