No child under the age of 18 years shall be upon any of the public streets, highways, alleys, parks or other public places of the Township of Pohatcong unless such child is accompanied by his or her parent, guardian or other person having the legal care or custody of such child, or is accompanied by a responsible person of good repute over 21 years of age, or is in the performance of an errand for or duty directed by his or her parent, guardian or legal custodian, or whose legal recognized employment makes it necessary for such child to be in or upon said public streets, highways, alleys, parks or other public places after the hour of 9:30 p.m., in which case such child shall carry a certified card of employment signed by the Mayor.
No parent, guardian or other person having the legal care or custody of a child under the age of 18 years shall allow or permit any such child to go or be in or upon any of the public streets, highways, alleys, parks or other public places of the Township of Pohatcong after 9:30 p.m., except as specified in § 118-1 of this chapter or unless reasonable necessity can be shown therefor.
The police of the township, upon finding a child under the age of 18 years in or upon any of the public streets, highways, alleys, parks or other public places of the Township of Pohatcong in violation of any of the provisions of this chapter after the hour of 9:30 p.m., shall take the name of such child and the name and address of the parent, guardian or other person having the legal care or custody of such child, send such child home and make report of the same to the Mayor within 24 hours; whereupon the Mayor shall send to the said parent, guardian or legal custodian of such child a written notice of the violation of this chapter, together with notice to such parent, guardian or legal custodian that unless the terms of this chapter are complied with, the penalty thereof will be invoked against such parent, guardian or legal custodian of such child.
The Mayor shall have the authority, when, in his opinion, the public safety, health, morals or welfare of the inhabitants of the Township of Pohatcong would be promoted, to issue a proclamation authorizing an extension of time; and he may specify the time for which this proclamation shall remain in force.
A. 
Any person 18 years of age or older violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $500 or by imprisonment for a term not to exceed 90 days, or by both such fine and imprisonment, in the discretion of the Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
Upon the violation of any of the provisions of this chapter by any person under 18 years of age, any member of the Police Department of the Township of Pohatcong concerned therewith shall determine whether, in his discretion, a complaint should be made to the Juvenile and Domestic Relations Court of the County of Warren. In any event, should such person become a repeated violator of the provisions of this chapter, as reflected upon the records of the Police Department of the Township of Pohatcong, then a complaint shall be transmitted through the Chief of the Police Department of the Township of Pohatcong to the Juvenile and Domestic Relations Court for such action as that Court, in its discretion, may deem proper.
